A good first step would be to disabuse people of the idea that the Supreme Court is good, actually.

steve is concerned with the implications of all of this for the judiciary but, with all genuine respect, i really think that one has to approach this as a problem of game theory

strategic political capture of the court has, for 40 years, been a one-way ratchet. among other things, this has inculcated a sense among conservatives that they can act with virtual impunity. showing them that their opponents will play hardball is a necessary first step toward a better status quo.

will try to answer these in a piece next week but for now i will say that part of the *point* of court expansion, in my mind, is to create a disequilibrium — a potential race to the bottom — that will force a truce.

It's actually worse, as Black Americans who lived in the South were able to move to the North, and did so in their millions. Palestinians in Gaza and the West Bank cannot do the equivalent.

As it turns out “did this person support Sanders in 2016” was not the perfect heuristic to understand whether someone has good politics or not. Weird how many people who should know better thought otherwise!

Basically every single pedagogical debate is like this: “Let’s move away from phonics, multiplication tables and testing because they leave kids behind” “Aren’t those the only things that work” “Yes” “And won’t it be less equitable in the end because rich parents can pay for tutors” “Also yes”

This is a wild misapplication of the test for a stay, sure, but it’s also just disconnected from how the real world works. In Alito’s mind, the only factor for determining whether something is legal is “Does Mister Trump want it.” A little bobblehead for fascism. Vile, stupid, get out of my face.

Genuinely an insane paragraph from Sam Alito. “Voter fraud is real and scary and we have to stop it, so the fact that implementing Trump’s mail ballot rule will disenfranchise millions is legally irrelevant.” Brain melted. A right-wing podcaster in a robe. www.supremecourt.gov/opinions/25p...

As for the equities, the Government has a strong interest
in enforcing the rule, and implementing it will also “en-

detect election fraud. 91 Fed. Reg. 54972. On the other side
of the balance, the plaintiff States invoke the practical ef-

enough to convince me to deny the application.
