Nicole is a leading expert on the issue of campus sexual violence. I am floored that USA Today would do this to her. I find this kind of journalistic behavior unethical and morally reprehensible, twisting an interview with a renowned advocate for survivors into a hit piece against a survivor.

like i say every time this comes up, the term for what awaits survivors who go through the official system (cops, rape kit at the hospital, the hell of a trial where you as the victim get to be cross examined by yr rapist’s defense) is called “the second rape”

For every story like the Cornell gang rape, there are thousands more that couldn’t make it into the light. I wrote about a few dozen of them at one university in On the Wrong Side. The university’s treatment of survivors is eerily similar to what Jane Doe at Cornell experienced.

One of my goals in writing this book was to get a copy in every college library so that survivors entering the Title IX system would know what they were getting into—and be able to use that knowledge however they wanted. But a lot of schools banned the book.

If you’re a survivor who wants your rapist removed from whatever social institution introduced you, that’s an okay thing to want. A lot of other survivors want it too. And in a different timeline, there wouldn’t be so many people shaming you for saying it out loud.

I spoke to @usatoday.com about data on sexual violence at Cornell. Victimization rates are increasing and reporting rates are falling. “Together… those two trendlines tell me that all students, including victims and perpetrators, believe that there is impunity for sexual assault at Cornell.”

Seeing people post about how unfair the “mob justice” against the Cornell rapists is doesn’t really move me when there is no justice for survivors. The system doesn’t work; it enacts further punishment on the victims. Society is even crueler. So spare me the “mob justice” rhetoric about the accused

A truly heinous man has doxxed the Cornell victim on X and the comments are predictably vile. Based on countless interviews I’ve done with survivors, the trauma they are subjected to for coming forward is oftentimes even worse than the initial trauma they experienced. This is why more women don't come forward, and why more rapists aren't jailed. Because mostly-male cops and prosecutors find it more believable that a 20-yr-old would want to have sex with a room full of fraternity brothers than accept she was raped. What ever happened to common fucking sense?

I’m genuinely worried that he weakened her civil case with this statement out of petty fury that he’s rightfully getting heat for not pressing charges against rapists. He clearly isn’t interested in seeing her succeed and he basically called her a liar—a huge gift to the civil defense

Goals and ambitions may become impossible to achieve. Timelines and hopes for the future may be derailed. At scale, college sexual abuse is a systemic force to prevent women and marginalized victims from having the same opportunities, health, and happiness as predominantly male perpetrators.

Just a remember of what rape can entail after the fact: permanent psychological damage. Permanent physical damage and disability. Hundreds of thousands of dollars in medical care, relocation fees, lost work, lost educational opportunity. A marred reputation. Broken trust, lost relationships.

This is always how it goes. The accused are allowed to ruthlessly and relentlessly smear the victims while engaging in a supposedly fair and just legal process that retraumatizes and creates fresh trauma for victims who are already supposed life altering, sometimes permanent consequences of rape

Another man accused, Scott Norris, denies that he partook in sexual misconduct but acknowledges in his own statement that misconduct took place. The men are already contradicting each other but I doubt any of them will be held accountable for making false statements while accusing the survivor of it

One of the Cornell students accused of gang rape, Scott Kretzschmar, denies it and says through his attorney that they are going to “confront” the survivor through the court system. I can already tell you that means victim-blaming, DARVO, and smears. She is going to need a lot more of our support.

I think its important to understand the campus sexual assault crisis is way worse than you think. universities suspend just 1/12,400 students each year for sexual misconduct & expel 1/22,900. once you read title ix administrators in their own words, you get a sense why that is:

Normally we'd expect an awful decision from the 5th Circuit, which is overall the most conservative federal appeals court. But we might actually get an ok one! Either way, there will be no changes to access as a result of this case until the Supreme Court has the final say. More background:
