So if they give you two doses of lethal injection and you're still alive, they take you to the hospital to stabilize you so they can just kill you again? Or is there a loophole for botched attempts because this is inhumane.

One of the many horrific aspects of the death penalty is that states are not good at carrying out executions. Every time I post about this, someone responds by saying that it should be simple. But it’s not, and proponents of the death penalty need to own that.

Press release I woke up to, on Christa Pike’s condition (sent 9/30 at 11:36pm ET)
Statement from Christa Pike’s attorney Randy Spivey and Kelly Gleason from the TN Office of the Post Conviction Defender, and Stephen Ferrell and Luke Ihnen from Federal Defender Services of Eastern Tennessee

Tonight the State of Tennessee once again failed to carry out a lawful execution. We take no pleasure in being right, but the concerns raised by Ms. Pike proved to be true: difficult vein access, blown veins, degraded pentobarbital, no emergency medical care available when things inevitably go wrong, all under a protocol that remains veiled in secrecy.

Christa is being treated at a nearby hospital. We have not been informed as to her condition.

This is inhumane. When I worked at the ACLU, our legal and policy teams were working hard to end executions via lethal injection because the government was not being transparent about the contractors supplying them with these drugs, their origins and makeup. The lawyers warned this would happen.

The thing about the death penalty has always been that it relies on an infallibility — after all, there's no reversing the punishment once administered — that no state in human civilization has ever achieved. But now there's another, rhyming problem: the state can't even properly administer it.

Capital punishment is barbaric regardless of its form, but it is interesting that the more clinical its presentation, and the further our remove, the greater and more prolonged the suffering. It is still premeditated murder committed by the state even if it’s dressed up as a medical procedure.

I'm appalled by the death penalty in general but lethal injection esp. makes me see red in how it's presented as a "humane" option that actually just quietly tortures people to death without making a mess. it's entirely about helping those complicit feel less guilty. and then shit like this happens.

Here’s Pike’s 2024 constitutional rights complaint challenging Tennessee’s new lethal injection protocol: “it fails to provide a contingency plan with emergency medical services on-site in the event of a botch“
Tennessee's new lethal injection protocol, calling for a single drug
(pentobarbital), is plagued with the same issues that have marked botched executions for decades: secrecy, intentional omission, inattention to detail, and untrained and unlicensed prison personnel attempting to fill a medical role. As the State of Tennessee seeks to execute its first woman in 250 years, and the only woman on Tennessee's death row—Christa Gail Piko—those problems have come to a head.
The new protocol, as applied to the Plaintiff and her unique medical conditions, is unconstitutional under the United States Constitution and the TennesseeConstitution. Tennessee's execution protocol further violates the Eighth Amendment because it fails to provide a contingency plan with emergency medical services on-site in the event of a botch. This violation applies to clectrocution as well as lethal injection.
Because of these failures the new protocol and is sure or very likely to result in unnecessary and superadded pain and suffering, terror, and disgrace as applied to the Plaintiff.

"Whether my clemency is granted or not, l am at peace."
"I am not afraid to die," wrote Pike, who has been on death row for more than three decades. "I'm only nervous about the process."
