I just took down a post I put up earlier today commenting on a Politico article spinning Alito’s CBS interview as “confirming” that he’s considering retirement. After watching the clip, my analysis didn’t hold up. Thanks to @adambonin.bsky.social for posting that in the replies and pushing back.

This will be one of the most important immigration cases in a generation. The Trump admin claims that a 1996 law mandates the detention of millions of people without any right to a bond hearing; every person who entered illegally, no matter how long in the past. If they win, it's a nightmare.

The Court's own ethics policy states that justices should explain the reason for their recusals. Only the liberal justices have honored this rule, and Alito continues to violate it.

Here's a graphic that does a better job of conveying the point than my original post: even by the (insane) standards of the first Trump administration, #SCOTUS is receiving—and granting—a truly unprecedented number of applications for emergency relief from the federal government:
A chart that shows the number of emergency applications filed and granted by the Supreme Court during each presidency dating back to George W. Bush, with the data annualized to show the far-higher frequencies since 2017, but especially during the Trump I and Trump II administrations.

Total number of substantive #SCOTUS rulings on Trump emergency applications since 1/20/25: 32 Rulings with dissents from 2+ Democratic appointees: 22 Rulings with dissents from 2+ Republican appointees: 5 The mail-in ballots ruling is a big one, but let's not lose sight of the denominator here.

NEW: the Trump administration renews its emergency plea to let the USPS rule on mail-in voting move forward. (Earlier it had withdrawn its application regarding a temporary restraining order against the policy. The TRO has been dissolved and now a preliminary injunction is in place.)

Loreto Javar, a green card holder who’s lived in the United States for over three decades and is being treated for Stage 4 prostate cancer, has been held at the Northwest ICE Processing Center in Tacoma for more than two months. 

A 76-year-old retired hotel worker who lives in Fife with his wife and daughter, Javar was detained by Immigration and Customs Enforcement officials June 23 during an interview for his U.S. citizenship application in Tukwila. He was receiving ongoing cancer treatment when he was taken into ICE custody, his family said, and has missed several medical appointments since his arrest.

One of the questions #SCOTUS will soon confront in the mail-in ballot cases is whether the so-called "Purcell principle" should apply to late-breaking changes in election rules adopted by the *federal* government, rather than the states. Today's "One First" explains why the answer ought to be "no":
