Right after Justice Kennedy retired, #SCOTUS materially shifted its Eighth Amendment jurisprudence, moving away from a test tied to "evolving standards of decency," and toward a static assessment of what was cruel and unusual in 1791. That shift will matter a *lot* if there's a challenge in Hasan.

A while ago I got pushback from some other urbanists on here for arguing that the Manhattan Institute’s main function is to mainstream racism. But the idea that their work on fairly technical urban policy matters is as politically significant as what Rufo is doing just doesn’t pass the smell test.
