here is the thing. if you tell me that you believe that race is a biological category and that it is a guide to the objective superiority and inferiority of groups of people, i am not calling you a racist to *insult* you, i am calling you a racist because it best describes your beliefs.

Any argument that Cofnas should be able to keep his job, despite not actually doing the research he was contractually obliged to do, because ppl are mad at him for his views, is just as easily turned into a reason to protect Arday's con artistry because the person who exposed him did it for racism.

i know this is presented as a rhetorical question, but the answer to “who is deciding what good science is or not?” can’t actually be “no one.” universities do (and should) act as gatekeepers.

I guess it's kind of hard to view the dismissal of one grublike phrenologist as a major hit to free speech after major American universities have in the past year banned the use of words and eliminated entire departments in the hopes of pleasing the senile president

let's be real: plagiarism scandals in academia happen all the time (not because academics plagiarize a lot, but just because of how many millions of faculty there are around the world) and it is never general-public news unless the culprit is a member of a minority.

It is a sign of the total failure of our constitutional order that, a mere six years after we were all desperately praying for a miraculous scientific breakthrough to end the worst global pandemic in a century, that the President of the United States can do what he did today & face no consequences.

'reasonable and almost certainly true position' literally, vibes. The thesis that constitutional democracy can flourish only if there has been homogeneity of culture of 1000 years is ridiculous because constitutional democracy is for most countries LESS THAN 100 YEARS OLD

JD Vance and Mike Johnson keep talking about "birth tourism." That's an extraordinarily infinitesimal occurrence, but note the sleazy trick they're using: They're trying to package this as fixing an isolated "problem," when their real target is much, much bigger. 4/ newrepublic.com/article/2127...

Ongoing "academic debate" bc people keep publishing ≠ open Q, cf. historians still publish that the Civil War wasn't about slavery but that doesn't make it live, just motivated. Your own reasons show the clause isn't perfectly self evident but that's true of literally any clause in constitution.

I appreciate this, but the problem is that legal academia has a unique & privileged pipeline to the commanding heights of American politics now, & that magnifies the problem of bad (faith) scholarship & imposes unique obligations on legal academics to police the discipline. And that's not happening.

If I were a “liberal” law professor who has been tongue-bathing FedSoc for years, I might rethink my position now that FOUR of the six FedSoc stalwarts on the Supreme Court voted to nuke the obvious meaning of the constitution’s birthright citizenship promise. I should tag some folks. But I won’t.

This is excellent. I want to preempt a legit concern, namely that there is no chance that Congress will actually do this. 1. We don’t know that, and shouldn’t assume it. 2. Even talking about this is good because it disrupts the Court’s monopoly on our constitutional imagination.

And you wonder why, Clara, with literally not even a moment’s self-reflection.
Law enforcement has told them to go the fuck home. Weijia Jiang, the president of White House Correspondents' Association, announced to room trump fine. They all clapped. She told the he's having a press conference in :30. They laughed. She told them he demands a redo within 30 days.
They cheered.

If I were the two posters above me, I might update my priors at this point. But what do I know, I'm neither a law professor nor a member of a "serious academic discipline" that doesn't peer review its "scholars'" publications.
Post from Brendan Benedict, reading, "In his draft paper, Kurt Lash says that our amicus brief in Trump v. Barbara at p. 27 claims "that Republicans viewed . . . the Romani as illegally in the United States".

What it actually mentions is "England's historical exclusions against the Roma people"

Still no correction."

really can't be said enough that this case was decided by the same court that decided plessy v. ferguson. if they could have found a plausible rationale to limit birthright citizenship they would have done it. but there is none! the text is as clear as constitutional language can be.
