I missed this decision. FRA gave Brightline West a Buy America waiver to buy ten trains from Siemens, two of which will be made in Germany. Alstom sued FRA, saying they shouldn't have granted that waiver. District Court dismisses on standing. DC Circuit: You do have standing—but you still lose.

This is interesting, but I don't think the central claim—credit card revenue and financing creates a moat—is correct. There's outsize return to being #1 in a city because loyalty programs make it worth giving 100% of your spend to an airline with 60% of the flights. This is true even without cards.

(I do not think the actual concern is litigation but what the Florida scientist actually said. Researchers need to work with external stakeholders and may worry stakeholders will not be willing or able to if you make them or their communities look bad—the same communities you're trying to help.)

I spend my week crossing london on a bike and increasingly that means cycling alongside Wayve/Waymo robotaxis. it’s uncomfortable. they give you so much space, don’t do a close pass while accelerating as lights go red. So unnerving if you cycle on assumption everyone’s mental and wants to kill you.
