Pierre Damas Bel was an honor student & part of his college's ROTC program. He was also a TPS recipient. After Trump's attacks on TPS, he was forced to wear an ankle monitor that isolated and humiliated him. Pierre died in an apparent suicide. He was 20.

We tracked the space financially, intellectually, and individually. Financially, 70% of the literature that disclosed funding was directly supported by EA orgs; 71% of the literature that didn’t disclose funding featured authors from funded orgs. We're talking hundreds of millions of dollars.

Fierberg is full of rockstars. They can really speak to what knowing your rights (and having the right representation) can offer survivors. It can be a lot trickier without an advocate like that in your corner. And there’s where the protection of a confidential office becomes so crucial.

One of the benefits of going to victim advocacy is that they cannot share any details about your case with anyone else—or open an investigation—without your explicit consent. You can’t guarantee that if you go directly to Title IX.

This is very interesting. Two thoughts: 1. This will be challenged. I wouldn't be surprised if challenges succeed. 2. You should be able to make officials who violate your constitutional rights pay for it, and if nothing else, this bill highlights how difficult it is-particularly w/r/t the feds.

To rephrase, Plaintiff who is ethnically and religiously Jewish wanted to become a franchisee. Business said they only franchise to Christians. Plaintiff sues, saying this is discrimination. Held: this is religious discrimination, but not racial discrimination. And § 1981 only reaches the latter.

5th Cir., joining the 7th Cir., holds that an auto-repair business that only franchises to Christians—including ethnic Jews who are professing Christians—does not commit racial discrimination in violation of § 1981, which does not reach religious discrimination. www.ca5.uscourts.gov/opinions/pub...
Domanic makes no serious effort on appeal to show any error in the district court’s ruling. That is unsurprising. As discussed, the evidence proved without contradiction that Christian Brothers has a longstanding and consistent policy of franchising only to professing Christians. And no evidence suggested that this policy was a pretext for racial discrimination against persons of Jewish ancestry (or any other ancestry). To the contrary, the undisputed evidence showed that Christian Brothers has franchised to two ethnic Jews who are professing Christians.  Domanic does make the novel argument that, as far as § 1981 is concerned, there can be no distinction between discrimination based on Jewish ancestry and discrimination based on Jewish faith. Section 1981, he contends, “protect[s] Jews . . . regardless of whether they are religious or ethnic Jews.” The district court correctly rejected this argument.

Imagine if we simply left murders by students on college campuses to be punished by colleges, using only the internal punishments they are able to inflict. We would find it insane and intolerable. Rape isn't that far off in terms of severity. Why are we putting utterly unsuited orgs in charge?

The reason for this is that we put universities in charge of punishing rape on college campuses instead of investing in better policing vs sex crimes. When someone does that the Cornell 7 are alleged to have done, there is a carceral solution. We need to unfuck sex crime investigation to get it.

If you are at a school with a more expansive mandatory reporting policy, this is a great time to advocate with other faculty to change that. There is NO federal law, regulation, or guidance that requires faculty to be mandatory reporters.

And as a reminder, disclosures of sexual assault in an educational context are often considered an exemption to mandatory reporting policies. Let your students speak freely! (I spoke to faculty at Cornell this morning who assured me that was the case on their campus!)
