Back in 2018, Boulder County filed a lawsuit in a Colorado state court against fossil fuel industry giants Suncor Energy and Exxon, alleging that the companies caused extensive—and expensive—alterations to Boulder’s climate. Boulder alleged that the companies knew that their unchecked production and promotion of fossil fuels would “result in dangerous changes in the climate,” but continued such activities anyway, and engaged in a decades-long campaign of “concealing” those dangers and “misrepresenting” them to the public.

As a result, the complaint says, instead of snow in the winter, Boulder gets more “high-intensity, short-duration rainfall events” that overwhelm its drainage systems and cause flooding. Instead of rain in the spring, Boulder gets more droughts that “have substantial implications for agriculture, wildfires and water availability.” And instead of warm days in the summer, Boulder gets more heat waves that lead to “premature deaths” and “adverse economic impacts,” particularly on outdoor labor sectors like agriculture and construction.

Boulder has already spent over $100 million repairing damage related to climate change, and expects to spend over $100 million more in order to adapt its infrastructure over the next 25 years, as it attempts to mitigate the effects of flooding, droughts, wildfires, and other harms. “Taxpayers cannot pay the full costs,” says the state’s complaint, “nor should they.”

The clearest and most succinct expression I've read of how, beyond the clear fascist rhetoric, the Prairieland prosecutions have terrifyingly expanded federal legal power, beyond the point many feds even wanted to go.
For other activists on the left — and on the right — the Prairieland case has set a dangerous precedent. Cadeddu, the federal defense attorney, told me that the most worrying of all the “terrorist acts” was vandalism. There is no dollar amount set on what sort of damage might qualify as an act of terror. Even throwing a snowball at an ICE vehicle during a protest and scratching the paint or damaging a taillight might qualify. “In theory, if you happen to be on a Signal chat with some people planning a protest, and one of the people at that protest — you don’t even have to know them — throws that snowball, you could be implicated in material support for terrorism, simply for helping to organize,” she says. “That’s the meaning of the case.”

What a lie. Some of these people are being imprisoned indefinitely in squalid condition in African prisons. Others report being beaten and arbitrarily deported in violation of international law back to their home countries, where they face persecution or torture.
The indefinite nature of their confinement has taken a severe toll. In October 2025, a Cuban man who was on the July flight went on a hunger strike for a month-until he started showing signs of organ failure —to protest the conditions of his detention, including his ongoing confinement and lack of access to legal counsel.
Terrified of being imprisoned in Eswatini forever, another man repeatedly told his attorney that the prison there never lets people go. One man told his attorney that he feels like a caged animal with no end in sight. The prison does not have air conditioning, making the hot, humid summer months especially uncomfortable for the men.
Food is insufficient, medication is scarce, and requests often go unmet or are belatedly met.
