Now and again, Quorum Report has published the results of polls without revealing how we got the numbers and without publishing the polling memo. It’s not our usual MO & it frustrates professional pollsters. When to do it, it’s a judgment call, for sure.

We’re doing it again today but not without first offering a prime example of how it can help your understanding of the shape of a campaign.

Many of you will remember that in January of 2020, Democrats and national media were portraying the special election in Fort Bend County between Republican Gary Gates & Democrat Eliz Markowitz as a “competitive” Texas House race when it turned out to be no such thing.

Rep. Gates won the election by 16 points. It was a result that vindicated a poll leaked by Republicans to QR a week out from the election. It showed Gates up by 13 points, with a margin of error of plus or minus 3. In other words, it was spot on.

This year, the race between Sen. Taylor Rehmet & GOP challenger Leigh Wambsganss in Tarrant County is likely more competitive than that 2020 special election turned out to be. Or maybe not.

Over the weekend, QR was given the results of a poll that we can tell you was conducted by a reputable GOP pollster on behalf of some DC trade groups more interested in North Texas congressional races. But the SD 9 contest, some statewide races, and Tarrant County judge were also included. It’s a poll of 600 likely voters in SD 9, which you’ll recall went for Trump by 17 points last time around. It was conducted Sept 10 to 15.

Late on Tuesday, Matthew Evans, the assistant U.S. attorney in Minnesota in charge of the case, told lawyers for Sosa-Celis and other victims to prepare for Castro to be charged “only with False Statements,” according to an email that was reviewed by ProPublica. 

That charge would likely carry a far less severe punishment if he were convicted.

“This is being directed by the Main Justice and the US Attorney,” Evans wrote in a remarkably candid account of internal deliberations. “I objected in the strongest possible terms and fought it as hard as I could. It wasn’t enough.”

This is VERY big news. Previously, even vacated or expunged convictions could still get someone deported, if an immigration judge determined that the conviction was vacated for reasons unrelated to a legal defect (such as for rehabilitation-related purposes). The 4th Circuit says not any more!
Courts and agencies have long struggled with how to analyze the immigration effects (if any) of a vacated conviction. Eventually, agency practice cobbled together a framework that sought to balance policy priorities. Under that framework, a conviction vacated because of a substantive or procedural defect in the underlying proceedings no longer qualifies as a conviction for immigration purposes, while a conviction vacated for rehabilitation, immigration hardship, or another reason still does. Many courts deferentially accepted that distinction. But the statute we apply here does not make the continuing effect of a vacated conviction turn on the state court’s reason for vacating it. It makes inadmissible “any alien convicted of” the relevant offense. 8 U.S.C. § 1182(a)(2)(A)(i). In this case, the petitioner’s conviction was vacated and her charge dismissed. At that point, she was no longer “convicted of” that offense. So we grant in part the petition for review
