Will is 100% right. Has happened to multiple clients of mine. One judge (not my case) has said that this isn't really release and ordered the person *actually* released. But it's forcing us habeas attorneys to win our cases twice (or more)
On September 9, 2026, Respondents permitted Pablo F. to exit the building where 
he was detained, but he was immediately swarmed by four ICE officers and handcuffed as 
soon as he stepped outside. (Doc. No. 25-3 at 4:48:45–4:49:26.)3
 The officers drove him
to the back of the Whipple building and returned him to a holding cell. (Doc. No. 21 ¶¶ 8–
9; Doc. No. 25 ¶ 5.) During this encounter, officers dislocated Pablo F.’s shoulder. (Doc. 
No. 21 ¶ 7.)4
 Pablo F. now bringsthis Motion seeking to enforce the Court’s Order granting 
the Petition.Again, Respondents make no attempt whatsoever to support their assertion that 
Pablo F. was released. Absent any such argument, the Court cannot agree that a reasonable 
person would have felt free to leave when exiting the detention facility and immediately 
being stopped by ICE officers. Likewise, absent some argument, the Court necessarily 
concludes that Pablo F. was subject to restraints not shared by the public generally when 
he took one step outside of the detention facility and was immediately stopped by ICE 
officers who forcibly returned him to a detention cell. Because Respondents do not make 
any legal argument that Pablo F. was ever meaningfully released from custody, the Court 
grants the motion and orders Pablo F.’s release.6
6 To be clear, Pablo F. is not arguing, and the Court is not concluding, that an order of 
release in a habeas matter renders unlawful any future arrests. Rather, the Court reaches 
the narrow conclusion that because Respondents advance no legal argument in this case to 
support their assertion that Pablo F. was released from custody, and because the 
uncontested facts show that ICE officers immediately swarmed Pablo F. as soon as he 
stepped out of the building, Pablo F. was not released from custody.

An ICE official desposed for this case was so evasive during a deposition that the judge declared her not credible. At one point, when asked to give a rough estimate of how many people were being held at 26 Federal Plaza in NYC in June 2025, she responded with "there's no such thing as an average."
Despite these facts, ICE officials – particularly Zanello – at other points in this case have attempted to downplay the level of overcrowding that existed during the summer of 2025. As the day-to-day supervisor of the tenth-floor hold rooms who was present on the tenth floor on at least most days from 7:00 a.m. to 3:00 p.m., she was quite evasive about how many people generally were held there at a time. [see Footnote 114 in next image] 

She would not provide even an estimate. In addition to her unbelievable claims that she could not recall approximately how many people were being held at any given time and that there is no such thing as an average number of people who were being heldFootnote 114: (“Q. Over the summer of 2025 while you were there . . . there were often 100 people held on the [tenth-]floor hold rooms at a time. Right? A. I would have to look at the day. Q. What is your best recollection as you sit here of the average number of people who [were] being held in the [tenth-]floor hold rooms in July 2025? A. There is no average that you can provide . . . . [T]he best I could do was a high and a low. Q. Okay. What’s the high and the low? A. I don’t know. Q. . . . [L]et’s take one time period each day. Let’s take noon . . . . What is your best recollection of how many people were being held there at noon in July? A. . . . . I would have to look at a specific date and time to give you that number . . . . Q. Okay. I’m asking you how many people do you recollect being held? A. It depends on the day. I would have to look at the day. Q. But you have no recollection of what the numbers were like as you sit here today under oath? A. It could have been zero. It could have been max. I don’t know. I would have to look at the day. Q. Okay. Give me a rough estimate of one of the most crowded days you can remember? A. I would have to look at the day. I’m not going to guess on a number. Q. Fair to say that at times there were more than a hundred people at a time? A. I would have to look at the day . . . . Q. But sitting here today you cannot even give a rough estimate of how many people were there? . . . . [A.]Footnote 14 continued.

The man ICE shot in Austin today is named Wilber Rafael Garces Perez. Per his lawyer, she and Perez’s family were run off of hospital property where he’s being treated and won’t even confirm he’s there because he’s “in ICE custody.” Actual criminals.
