it should not be news that non-citizens should avoid at all costs being involved with the sale, growing, sale, or possession of cannabis, no matter what state law says, because ICE will use it to exile them from the US. I suspect that not all people who should know this, do. Rescheduling, when.

Mullin can’t speak honestly about Delaney Hall if he’s never walked through its doors. People are suffering. I’ve seen it firsthand, I’ve heard from detainees. It’s brutal. So because Mullin can’t show up for his job, I made sure he heard the truth from me.

Lawgeeks, Judge Mendoza has a *remarkable* concurring op. discussing "the two-facedness of the government’s cynical maneuvering." (argued one thing in the brief and then reversed during OA)
In its answering brief, the government originally conceded that limited remand was appropriate to allow the BIA to address its failure to consider the evidence of PerezGarcia’s payment of his voluntary departure bond.  Yet, at 12 PEREZ-GARCIA V. BLANCHE oral argument the Government took the extraordinary position that this court lacked jurisdiction to review the BIA’s voluntary departure denial entirely.  Putting aside the two-facedness of the government’s cynical maneuvering, it is worth taking its arguments to their full logical conclusion.  Essentially, the government’s position is that if an agency entirely fails to consider dispositive and highly relevant evidence in an application for discretionary relief, the noncitizen is simply out of luck and left with no recourse from this court.  That is wrong.  The government’s position flies in the face of both this court and the Supreme Court’s precedent.

9th Cir., 2-1, holds that a failure of the Board of Immigration Appeals to consider record evidence (just straight-up ignored the evidence) is a reviewable legal error, not a factual error outside of the court's jurisdiction. cdn.ca9.uscourts.gov/datastore/op...
An “obvious” factual error is still a factual error. See Patel, 596 U.S. at 334, 339. But failing to consider critical evidence is legal error. If we were to adopt the dissent’s position, the agency could completely abdicate its role in cases involving the jurisdictional bar, refuse to consider any evidence in the record, and simply conclude that a petitioner failed to submit evidence. In the dissent’s view, that would be an unreviewable “factual determination.” We reject this absurd result. In short, the BIA legally erred by failing to consider Perez-Garcia’s proof of payment of his voluntary departure bond.

This type of blithely indifferent “reasoning” by the majority - partisan, unfair, biased, indefensible - renders its decisions illegitimate. We will not treat this Court as exercising lawful authority lawfully. It isn’t. We must bring it to heel or democracy will die.

A couple solutions come to mind. A federal judge should order the director of the local field office detained at Miramar under the same conditions as the worst-off person is suffering. See if that fixes the understaffing or the inhumane conditions or the priority to detain w/o limit

NEW: @apnews.com confirms that ICE has begun electronically "disappearing" people in the agency's custody who have final orders of removal. As of last week, anyone jailed by ICE with a final order of removal will NOT appear in the ICE Online Detainee Locator System, making them effectively vanish.
