I listened to YIMBY Action’s debate on Prop 45 last night. I was struck by how the Yes side advanced absurd, frivolous and obviously wrong interpretation of 45 but also AB 130 with respect to infill, transportation and data centers.

It should be obvious, but talks about adapting to climate change or colonizing another planet often ignore that humans (and animals/plants that we love and love to eat) evolved to live on Earth in the climate we have today, and we built our infrastructure for today's climate. Everything else sucks.

With this in mind, the unwillingness or inability of America’s governing institutions to make use of the available constitutional tools takes on an additional significance. It is asking too much to hope that everyday citizens will be able to, on their own, closely track the decay of democratic norms and protections and formulate well-thought-through opinions on which presidential candidate is best positioned to protect them. It may be asking too much to expect that voters will choose rationally at all. (Readers may be familiar with a paper by Bartels and his co-author Christopher Achen arguing that Woodrow Wilson lost his home state of New Jersey in his 1916 reelection campaign not because of disagreement with Wilson’s policies among the state’s residents, but because of a spate of shark attacks along the Jersey Shore.) 

Rather, it is the responsibility of politicians and other powerful actors—like attorneys general and Supreme Court justices—to use their knowledge and influence to maintain the integrity of the constitutional structure. That responsibility will weigh heavier during Trump’s second term. Whether these institutions can measure up to it this time around is a different question.

The current days of delay and debates can seem to drag on forever, but the next presidential election is right around the corner, and so is 2030. When Trump pours money into coal, California must fight back. My new bill, AB 40, ensures that no large-scale coal terminal is approved in our state without a full environmental review based on the actual project and the most current science.

Wow. Proponents of the ICE taser gloves are openly saying that one reason they love the gloves is that they doesn’t leave any marks or proof that they were used, making it harder for people to sue when they’re shocked excessively.

Let's assume for the sake of argument that political elites cannot affect public opinion, only pander to it. Even then, you must anticipate trends in public opinion. It doesn't take a rocket scientist to anticipate that an internal masked authoritarian police force will soon become unpopular.

Plaintiffs’ arguments to the contrary rely exclusively on our decision in California Restaurant Association v. City of Berkeley, 89 F.4th 1094 (9th Cir. 2024) [hereinafter CRA]. But as explained below, Plaintiffs read CRA far too broadly. Contrary to Plaintiffs’ assertions, our “very narrow” decision in that case did not consider the issue now before us: whether EPCA preempts state regulations enacted pursuant to another federal statute, like the CAA. Id. at 1106.  Finally, even if we were to accept Plaintiffs’ interpretation of the scope of EPCA’s preemption provision, their facial challenge nonetheless fails. Plaintiffs cannot show that the Rule is unconstitutional in every application because the Rule regulates emissions from process heaters, which are not among the list of covered products under EPCA and for which the DOE has not issued any federal standards.
