I listened to YIMBY Action’s debate on Prop 45 last night. I was struck by how the Yes side advanced absurd, frivolous and obviously wrong interpretation of 45 but also AB 130 with respect to infill, transportation and data centers.

Wild. But more sabotage than self-own. For this administration, starving the government of revenue is a small price to pay for causing harm to immigrants. And at worst, reducing both revenue and IRS capacity may even be secondary goals here.

It should be obvious, but talks about adapting to climate change or colonizing another planet often ignore that humans (and animals/plants that we love and love to eat) evolved to live on Earth in the climate we have today, and we built our infrastructure for today's climate. Everything else sucks.

With this in mind, the unwillingness or inability of America’s governing institutions to make use of the available constitutional tools takes on an additional significance. It is asking too much to hope that everyday citizens will be able to, on their own, closely track the decay of democratic norms and protections and formulate well-thought-through opinions on which presidential candidate is best positioned to protect them. It may be asking too much to expect that voters will choose rationally at all. (Readers may be familiar with a paper by Bartels and his co-author Christopher Achen arguing that Woodrow Wilson lost his home state of New Jersey in his 1916 reelection campaign not because of disagreement with Wilson’s policies among the state’s residents, but because of a spate of shark attacks along the Jersey Shore.) 

Rather, it is the responsibility of politicians and other powerful actors—like attorneys general and Supreme Court justices—to use their knowledge and influence to maintain the integrity of the constitutional structure. That responsibility will weigh heavier during Trump’s second term. Whether these institutions can measure up to it this time around is a different question.

The current days of delay and debates can seem to drag on forever, but the next presidential election is right around the corner, and so is 2030. When Trump pours money into coal, California must fight back. My new bill, AB 40, ensures that no large-scale coal terminal is approved in our state without a full environmental review based on the actual project and the most current science.

I don’t think the original post here was really mistaken. The justices made very pointed and harsh comments to him, so “dressing down“ isn’t an unreasonable interpretation. It’s just incomplete. And yes, he made things worse for himself—seemingly not comprehending what the Court was asking of him.

The justices also had several issues they wanted him to speak to, including responsibility for the mistake, remedy, & client communication. When he revealed that he had not informed the client or the clients relatives of the reason, there was a “problem” with his brief, that led to more frustration

They repeatedly pointed out this isn’t an “AI issue”: if he had submitted a brief with false information because a rogue associate drafted it & he failed to review, he would’ve been in exactly the same position. And he kept just repeating his view that better AI policy is what’s needed.

To be fair, not only was it an OSC on this specific issue, but also, it was all colloquy, not just dressing-down. Instead of answering their questions he kept suggesting the court develop rules to stop other lawyers from making the same mistake. They tried to redirect him but he wouldn’t engage.

That piece uses that phrase multiple times, without explaining what it means, or the relationship between whatever it is and expertise. Also, that essay itself was largely written with generative AI, and is remarkably repetitive and superficial.

And both of them are among the best political essayists out there, and I am not only untroubled, but happy, that they have the broad reach they have because of the NYT platform. Most of their other op-ed content deserves the criticism it gets, and more, of course.

Oh definitely. I’m just weary of people’s reactions to actual good NYT content being so negative. It just seems really like a tired cliché at this point to take any piece Bouie or Gessen publishes that’s good as an opportunity to trash NYT for their bad stuff instead of elevating the good stuff.

No argument with the premise that NYT has been terrible on this for years— but the more constructive reaction to this op-ed would be more like “ everyone should read this!”— because it’s excellent, and it would be very valuable for everyone, especially median NYT readers, to read it.

Wow. Proponents of the ICE taser gloves are openly saying that one reason they love the gloves is that they doesn’t leave any marks or proof that they were used, making it harder for people to sue when they’re shocked excessively.
