from a real-world standpoint it's obvious untenable and unacceptable and incredibly obscenely immoral -- but also from a theoretical pov, from a Weberian pov, what the fuck is the US government if this one guy, who is not elected and not in the gov't, is making these kinds of decisions?

Miller has talked about civil lawsuits, and Capitol Hill investigations and subpoenas – but perhaps the thing that stands tallest in his mind is local and state prosecutors who he says want to put him in a “prison cell.” Federal pardons can make it harder to prosecute former U.S. appointees locally, but such clemency does not preempt local and state prosecutions and investigations in the same way that it would federal probes.Miller has also privately said he’s worried that Democratic members of a future federal administration may try to get creative, and hunt for ways to get around Trump’s federal clemency actions. (Trump himself, thanks to his far-right pals on the Supreme Court, enjoys an expanded protection of presidential immunity; his underlings, however, don’t enjoy the same privileges… at least not yet!) Miller has also lamented the possibility that liberals will be filing lawsuits against him for years, if not decades, and complained about how the left will try to use “lawfare” to bleed him and his wife – former Trump official and current right-wing lifestyle podcaster Katie Miller – dry financially. (The Millers have a lot of money between them, and they lead at times extravagant lives and enjoy projecting an image of being some of the nation’s top MAGA socialites.)

This fraud was then perpetuated by Elon Musk himself, who was running DOGE at the time, and who retweeted a post about the incident while declaring it a "criminal act." The government now "concedes ... that Mr. Musk and officials at FEMA and DHS knew this information was false."
vi. February 11, 2025, Statement by Elon Musk On February 11, 2025, Elon Musk, a Special Government Employee and head of DOGE, retweeted on X a photo of Ms. Comans along with the statement, “FEMA CFO Mary Comans was just fired for funneling $58M to illegal migrant hotels in Manhattan” and he called it a “criminal action.” The Government concedes and the Court finds that other than the fact that Ms. Comans had been fired, the post by Mr. Musk was entirely false. The Government further concedes and the Court further finds that Mr. Musk and officials at FEMA and DHS knew this information was false at the time it was posted. Based on the unchallenged facts and the fact that Mr. Musk was the head of DOGE, he knew or should have known that any payments made to state or local governments through a FEMA grant in February 2025 were approved by his subordinates. Finally, the fact that Mr. Musk posted a picture of Ms. Comans to his millions of followers while falsely characterizing her government service as a “criminal action” was clearly intended to make her afraid. Posting Ms. Comans’ picture served no legitimate governmental interest and was little more than state sanctioned intimidation.

DHS made multiple false statements to the press. To Fox News, DHS lied and claimed Ms. Comans had "circumvent[ed] leadership and unilaterally" reimbursed local governments for shelters for migrants. DHS now admits in court it "knew the statement was false at the time it was made."
iii. February 11, 2025, Statement by DHS Spokesperson to Fox News On or about February 11, 2025, a DHS spokesperson provided an on-the-record statement to Fox News that “four employees are being fired today for circumventing leadership and unilaterally making the egregious payment for hotels for migrants in New York City” and that the “[f]irings include FEMA’s Chief Financial Officer, two program analysts and a grant specialist.” The statement was published by Fox News. The Government concedes and the Court finds that other than the fact that Ms. Comans had been fired, the statement to Fox News was entirely false. The Government further concedes and the Court further finds that officials at FEMA and DHS knew the statement was false at the time it was made

WOW. Kristi Noem and Elon Musk, among others, "chose to turn the power of the federal government against a singular employee with an impeccable record of public service. ... The attacks against Ms. Comans were based entirely on false information" and many officials "knew [they] were untrue."
In conducting this hearing, the Court is not called upon to resolve factual disputes between
the parties. The facts set forth in this Memorandum Opinion and Order were proposed by the
Plaintiff, unobjected to by the Government, and then deemed admitted by the Court. Dkts. 74, 75,
77.2 These facts establish that high-ranking government officials, including then Secretary of DHS
Kristi Noem and Elon Musk, engaged in a coordinated public relations campaign to impugn the
personal and professional integrity of Ms. Comans. For reasons unfathomable to this Court,
officials chose to turn the power of the federal government against a singular employee with an
impeccable record of public service. In short, Ms. Comans was professionally targeted and
personally attacked by government officials for no legitimate reason. The attacks against Ms.
Comans were based entirely on false information, and many government officials knew the
accusations were untrue at the time they were made. With no regard for the truth and with no
consideration for the personal and professional effect on Ms. Comans, government officials
exploited their access to mass media outlets to broadcast false information. These false
statements reached hundreds of millions of people. The purpose of this Order is, to the best of
this Court’s ability, to correct the public record and establish as a matter of law that the
statements made by these officials about Ms. Comans were objectively and demonstrably false.

Former “free speech” crusaders have ushered in an unprecedented campaign of censorship in Texas universities, resulting in pulitzer winning books being banned, medical and scientific facts being suppressed, and entire fields of study deemed “woke” being eliminated www.theatlantic.com/ideas/2026/1...
Over the past decade, some conservatives have invoked principles of academic freedom and free speech in order to subvert both. These conservatives mocked “snowflakes” and “trigger warnings,” and then passed legislation making it illegal to hurt white students’ feelings by discussing historical or contemporary events. They invoked academic freedom and then began erasing fields of study they found politically inconvenient. They railed against “indoctrination,” and then argued that the state is entitled to control everything said in the classroom.
