I know because capitalism and whatever but it sucks looking at the catastrophic amounts of money and resource that go into sustaining car dependency and forcing generative AI on people and then thinking what anything like that money and resource could do for public and active transport and the arts.

Amendment ultimately will strip Congress of its authority to articulate its own constitutional vision —and will force upon it a tamed, Court-approved understanding of its own powers.To deny Congress meaningful enforcement authority is to deny it any substantive role in shaping constitutional meaning. This project emerged from City of Boerne v.
Flores, a 1997 decision in which the Court's conservatives held that Congress possesses
"the power to enforce, not the power to determine what constitutes a constitutional violation." Callais smuggles that principle into the tatters of the Voting Rights Act.
Traces of it pervade Shelby County and Brnovich, but Callais invokes Boerne for authority and is accordingly more transparent in its embrace of supremacy as such. In so doing, it dismantles a longstanding constitutional settlement in which Congress and the Court jointly elaborated the meaning of foundational guarantees.On one level, Callais is about the mechanics of representational democracy: about whether people have a voice in government, whether legislators respond to them, whether citizens recognize themselves in those who govern.
But Callais reaches something deeper, about constitutional democracy itself: about whether the Constitution, the law of laws, means what elected branches say it means, and whether those elected branches can act on that meaning. The Court has declared that the branch of government most accountable to the people cannot legislate its way toward a more inclusive democracy.
At the same time, the Court —the branch of government least accountable to the people-has claimed for itself the sole authority to say what the words of the Constitution mean. And it wields that power to entrench
discrimination and wall off the paths by which a democratic society might redeem its most aspirational promises.

A great blue heron takes flight across a pond at one of my favorite nature areas in Longmont, Colorado. In this horizontal color photograph, the heron is captured mid-liftoff—its beak slightly open, wings raised, and long legs trailing beneath it as it springs into the air.

I was anticipating the moment. The heron had been perched on the far-right log in the cattails beside a walking path. I noticed people approaching-first a fisherman who paused, then a woman walking her two small dogs. Right on cue, as they drew close enough, the heron launched into flight.

I thanked the woman and showed her the photograph.

The scene is a medium view of the pond, where soft reflections of clouds and patches of blue sky ripple across the water's surface. In the lower right, a weathered log emerges from newly growing cattails, angling leftward, with a small branch reaching toward—but not quite touching-the water. Both the log and branch are mirrored in the pond. Another log rises from the cattails at the far right, while a few delicate twigs break the surface near the upper center of the frame.

The image captures both the raw power and the quiet beauty of the moment.

Let’s not pretend that Obama started it though. Replacing Thurgood Marshall with Clarence Thomas was done by Bush 1. Alito and Roberts are the product of Bush 2, while Kavanaugh was an operative in 2000. Obama supercharged the mission, but he didn’t set it. That was done in 1965.

Schumer & Jeffries should be on the steps of the Capitol or in front of the Court with voting rights activists and others and state plainly, "John Roberts does not think Black people should have the right to vote or deserve representation in Congress." State it plainly so normal people get it.

There’s only one way out of this, and it involves people using what voting power they have to to send people to Congress committed to multiracial democracy. Congress can overrule the Supreme Court on this. It can pass a new Voting Rights Act that explicitly defines what “intentional” discrimination looks like over and above what Roberts and Alito say it does. It can outlaw vote dilution. It can require disparate-impact analysis, and it can attempt to hold the Supreme Court to Congress’s interpretation of the Constitution through the practice known as “jurisdiction stripping.” Essentially, Congress can say “our interpretation of the 15th Amendment can be enforced by this new Voting Rights Act, and our interpretation is final.”

Beyond that, if Democrats take back the House and the Senate, kill the filibuster, and elect a Democratic president in 2028, Congress can pack the court and fill it with people who do not believe in a white’s-only theory of voting rights. Those new justices could overrule not just Callais but all of the other voting rights cases the Roberts court has issued to try to destroy minority voting rights. Those new justices could overturn the court’s prior gerrymandering decisions. A new court could reject the white supremacy the Roberts court embraces.All of that will require a lot of political will, but it can start with the midterms. Democrats simply must take control of Congress and the Senate in November. Then, they must win the presidency in ’28, and hold that control through the 2030 Census. Thanks to Callais, this may be the last opportunity for Democrats to do so, because after 2030, if Callais has not been thrown in the trash, it will be very hard for Democrats to wrest political control from Republicans for decades.

Black people have used their political power to support the Democratic Party since the passage of the Voting Rights Act. In response, the Republican Party has set out to kill the VRA and reduce Black power to that of the Jim Crow era. Republicans have succeeded. We’ve got about four years to reverse their gains, or their victory will be complete.

The Voting Rights Act is dead. We need a new one, or the racists win. It’s as simple and as depressing as that.

The title is fitting. A patient was being treated for Stage IV colorectal cancer. She had qualified for clinical trial, a her last-chance to slow the spread of her cancer. Her trial was about to start when NIH funding was pulled overnight, & it was canceled. She died. Many more stories. 🧪
