I think it's a pretty reasonable conclusion that any judge that now refuses to stop all lethal injections in the country immediately as an unquestionable Eighth Amendment violation has completely abrogated their duty as a judge and should be removed from the bench, all the way to SCOTUS.

(pentobarbital), is plagued with the same issues that have marked botched executions for decades: secrecy, intentional omission, inattention to detail, and untrained and unlicensed prison personnel attempting to fill a medical role. As the State of Tennessee seeks to execute its first woman in 250 years, and the only woman on Tennessee's death row—Christa Gail Piko—those problems have come to a head.
The new protocol, as applied to the Plaintiff and her unique medical conditions, is unconstitutional under the United States Constitution and the Tennessee

Constitution. Tennessee's execution protocol further violates the Eighth Amendment because it fails to provide a contingency plan with emergency medical services on-site in the event of a botch. This violation applies to clectrocution as well as lethal injection.
Because of these failures the new protocol and is sure or very likely to result in unnecessary and superadded pain and suffering, terror, and disgrace as applied to the Plaintiff.

One important policy lesson from this story is how Facebook committed blatant tax fraud in 2013 (Zuckerberg's stock options as R&D) and still hasn't been forced to pay it and thus learned that tax fraud is an acceptable business practice and so is doing it again.

We recently helped another cat with severe, debilitating IBD whose symptoms reminded me so much of Eevee, but to get him well from the brink of death cost over $12,000. Simply put, we do not have that right now. But I can’t just continue to let Eevee slip away without doing everything we can to try.

She has lost interest in food, where normally she never has refused anything offered to her. She has struggled with her weight and body condition over the last year and a half, but she is now really wasting away, not grooming herself or interested in playing. She’s fading & we still don’t know why.

Not long after her adoption, her symptoms returned (despite no change in her food). She went through so many rounds of fecal tests, PCRs, bloodwork, X-rays, special diets, allergy treatments, and nothing has definitely helped her. Every time we get close, she relapses. Now, she’s taken a real turn.

Eevee had dealt with some very challenging chronic diarrhea while she was a kitten, but before adoption, we figured out a food that worked for her & she was all better (thread)

There is a moment at the very very end of Abdul El-Sayed's podcast with Ezra Klein (book recommendation section) where he talks about the idea of "speaking truth to pain" and this will be staying with me for an extremely long time. www.nytimes.com/2026/09/25/o...

But there’s also something about truth to pain. We talk a lot about truth to power, but I think it’s actually a lot harder to speak truth to pain. I say that as someone who went to medical school, realizing that in a lot of our politics right now, we’ve got to get a lot better at speaking truth to pain if we’re going to get through some of these challenges that we have.

What does “truth to pain” mean?

It’s one thing to look power in the eye and say: You’re wrong about this. But there’s a way in which pain is very difficult to reason with. Because when somebody is in their pain, they’re in their trauma. They see that pain, and they may not see what’s causing it.

I remember just very explicitly being in a trauma ward with a gunshot wound patient and watching this big guy with his hand on his gunshot wound. All the folks are trying to pull his hand off his pain, that point of his gunshot wound, this clear vulnerability.

And this emergency room doctor had the presence of mind to be like: Everyone, stop. And she looks him in the eyes, and she’s like: I get that really hurts, and I’m so sorry that you’re here. You don’t want to be here. We don’t want you to be here. But if you don’t let us fix this, you could die. So I’m going to take your hand, and I’m going to move it off, OK? Because I need to get there so that you can live.

She was speaking truth to pain. He understands he’s at the hospital, he needs care, but he also doesn’t want anybody to touch the wound. Which is a natural thing. And I think it is a really great metaphor for how we think about a lot of these challenges we talked about today.
