Most people in the USA have been very willing to allow a great deal of state violence so long as they do not need to witness or experience it regularly. MAGA has used this to push the limit of how much violence the USA will tolerate. There is no reason to think the escalation will stop.

Defendants do not dispute that this Court has the authority to retain jurisdiction over this case pending the completion of FDA’s mifepristone review. See ECF Doc. 101 at 4–5 (citing cases). Nor do they dispute that it would be improper for FDA to disregard the statutory factors that should guide its mifepristone review in favor of political considerations. Instead, **Defendants disparage Plaintiffs’ concern about political interference with FDA’s review as “unfounded speculation.”** ECF Doc. 102 at 4. **Far from it — Plaintiffs have the receipts.**
Last week, in response to a FOIA request, Plaintiffs’ counsel received a production of FDA documents that included **a September 3, 2025 email from an “eop.gov” email address asking FDA and HHS for “a briefing on the status of the FDA [mifepristone] study design and proposed timelines.” Exhibit A. “EOP” stands for “Executive Office of the President” and “eop.gov” is the email address for the White House.** An HHS employee agreed the agencies would “do our best to accommodate.” Id. Gosh. What a surprise that Brendan Carr is a fucking coward. Comedians making jokes on late night TV requires an investigation into the "public interest" standard, but a literal execution is "not my job, go talk to Hegseth who is doing a great job."
A livestream falls outside of the FCC’s regulatory power, but the Pentagon feed is something that, absent restrictions, broadcasters could pick up. The FCC’s obscenity, indecency and profanity guidelines do not directly address executions, but under his tenure, Carr has launched investigations of networks on the grounds that they may not be meeting their public interest obligations. FCC guidance earlier this year emphasized, among other things, that stations must air programming that is “responsive to the needs of their local communities.”

“My understanding is it’s not on broadcast TV, so I don’t think there’s a role for the FCC one way or the other there,” Carr said on CNBC. “But I trust Secretary Hegseth. I mean, he’s implementing the laws and regulations that are relevant to the Department of War, and I think he’s doing a great job, and I trust that he’s making the right call on these issues.”

This thing has made me go do a lot of reading tonight, and the Wikipedia page about the last public execution in the United States is well-written. It was Rainey Bethea, a Black man hanged in front of a crowd of 20,000 in 1936, a spectacle which embarrassed Kentucky enough that they ended hangings.
Hanna placed the noose around Bethea's neck, adjusted it, and then signaled to Hash to pull the trigger. Instead, Hash, who was drunk, did nothing. Hanna shouted at Hash, "Do it!" A deputy then leaned onto the trigger, which sprang the trap door. citation needed! Bethea fell 8 feet (2.4 m), and his neck was instantly broken.
Afterward, two doctors confirmed he was dead.
His body was taken to Andrew & Wheatley
Funeral Home. Icitation needed! He wanted his body to be sent to his sister in South Carolina so that she could arrange for him to be interred next to his father, but against these wishes, he was buried in a pauper's grave at Owensboro Cemetery (also known as City Cemetery and

Kentucky
As the Kentucky General Assembly had been meeting in its biennial sessions at the time, the media circus surrounding the Bethea execution embarrassed members of the Kentucky
legislature. In spite of the humiliation, they could not amend laws regarding executions until the next session in 1938. However, the trial judges in two separate Kentucky rape cases ordered that the hangings of John "Pete" Montjoy and Harold Van Venison be conducted privately. Montjoy, age 23, was privately hanged in Covington on December 17, 1937.On January 17, 1938, William R. Attkisson of the Kentucky State Senate's 38th District (representing Louisville), introduced Senate Bill 69, repealing the requirement in Section 1137 that executions for convicted rapists be conducted by hanging in the county seat where they raped their victims. The bill was promoted in the Kentucky House of Representatives by Representative Charles W. Anderson Jr., one of the attorneys who assisted Bethea in his post-conviction relief motions.
After both houses approved the bill, Governor Chandler signed it into law on March 12, 1938; it became effective on May 30 of that year.
Chandler later expressed regret at having approved the repeal, claiming, "Our streets are no longer safe." The last person ever legally hanged in Kentucky was Harold Van Venison, a
33-year-old African-American singer, who was privately executed in Covington on June 3, 1938.
