What everyone has to prepare for is the constitutional crisis to accelerate if the Democrats take the House and the Senate. Vought has been allowed by the Republicans to act with impunity, so have he will continue to ignore Congress. This is why you have to impeach him immediately.

Will is 100% right. Has happened to multiple clients of mine. One judge (not my case) has said that this isn't really release and ordered the person *actually* released. But it's forcing us habeas attorneys to win our cases twice (or more)
On September 9, 2026, Respondents permitted Pablo F. to exit the building where 
he was detained, but he was immediately swarmed by four ICE officers and handcuffed as 
soon as he stepped outside. (Doc. No. 25-3 at 4:48:45–4:49:26.)3
 The officers drove him
to the back of the Whipple building and returned him to a holding cell. (Doc. No. 21 ¶¶ 8–
9; Doc. No. 25 ¶ 5.) During this encounter, officers dislocated Pablo F.’s shoulder. (Doc. 
No. 21 ¶ 7.)4
 Pablo F. now bringsthis Motion seeking to enforce the Court’s Order granting 
the Petition.Again, Respondents make no attempt whatsoever to support their assertion that 
Pablo F. was released. Absent any such argument, the Court cannot agree that a reasonable 
person would have felt free to leave when exiting the detention facility and immediately 
being stopped by ICE officers. Likewise, absent some argument, the Court necessarily 
concludes that Pablo F. was subject to restraints not shared by the public generally when 
he took one step outside of the detention facility and was immediately stopped by ICE 
officers who forcibly returned him to a detention cell. Because Respondents do not make 
any legal argument that Pablo F. was ever meaningfully released from custody, the Court 
grants the motion and orders Pablo F.’s release.6
6 To be clear, Pablo F. is not arguing, and the Court is not concluding, that an order of 
release in a habeas matter renders unlawful any future arrests. Rather, the Court reaches 
the narrow conclusion that because Respondents advance no legal argument in this case to 
support their assertion that Pablo F. was released from custody, and because the 
uncontested facts show that ICE officers immediately swarmed Pablo F. as soon as he 
stepped out of the building, Pablo F. was not released from custody.

It’s absolutely true that victims might need time to process what happened to them before they label it rape. It’s absolutely true that trauma can make it harder to access memories—especially in high-stress settings and in the absence of trauma-informed methods.

Another story that always comes to mind is from my days as a hospital victim advocate. There was a victim who had been brought to the hospital after being found in public, unconscious, and in a state of undress. She had very limited recollection of what had happened.

But she had, in fact, warned the investigator about the gaps in their first meeting. They didn’t write it down. And then they blamed her later and used that as an excuse to keep her perpetrator on campus.

Her abuser had shared a full transcript of texts. Investigators knew what was missing and knew it wasn’t relevant to the case. But they claimed she wasn’t credible because she hadn’t explained why those texts were missing.

For my book, I interviewed victims, perpetrators, and school administrators. In some cases, I interviewed multiple people with different perspectives. In one case, a victim was determined “not credible” because she had deleted some of her texts with her abusive ex-boyfriend.

In the age of technology, we all expect that every conversation will be recorded. But that isn’t true. A lot of records come from the recollections of someone in a position of power. And we know that investigators—including police and Title IX—severely overestimate the amount of false allegations.

According to the internal report on Blaise's death, "A mortality review committee (MRC) determined BTC did not provide Ms. BLAISE medical care within the safe limits of practice."

The MRC found that, after Blaise collapsed, "1) BTC health staff deviated from basic life support (BLS) protocols; 2) Health staff failed to initiate cardiopulmonary resuscitation (CPR), despite Ms. BLAISE's pulselessness; and 3) Health staff did not include Ms. BLAISE's vital signs with their documentation of the emergency response."

The mortality report contradicts the public report ICE published on Blaise's death, which claimed that staff called for emergency medical services (EMS) and "immediately began cardiopulmonary resuscitation" and "continued providing CPR until EMS personnel arrived."

By all means, be inspired by @lilymasonphd.bsky.social's conclusion. But it's as important to attend to its analysis: the polarization frame suggests political responses that consolidate anti-democratic gains & autocratization of the political system. Fighting for progress is what's called for.
The United States can be a democracy in which every citizen shares the same rights and dignity before the power of the state, corruption is held to account, and benevolence toward other democracies is assumed. With the understanding that the country has yet to fully live up to these goals, we have certainly tried, at least until recently, to achieve them. We are now experiencing the backlash to that progress.

But the fury of the argument shows the importance of the outcome. When we focus on polarization as the problem, the solution is for everyone to quiet down and be “civil”—an outcome that benefits those who are willing to grab as much power as they can without concern for legality or civility. When we see the problem for what it is, the solution is to defend the most robust social progress in American history—progress that has already been codified into law and enjoyed by everyone alike. U.S. democracy needs leaders who are willing to defend those rights and voters who are willing to hold accountable the leaders who will not defend them. It does not need everyone simply to calm down.
