Will is 100% right. Has happened to multiple clients of mine. One judge (not my case) has said that this isn't really release and ordered the person *actually* released. But it's forcing us habeas attorneys to win our cases twice (or more)
On September 9, 2026, Respondents permitted Pablo F. to exit the building where
he was detained, but he was immediately swarmed by four ICE officers and handcuffed as
soon as he stepped outside. (Doc. No. 25-3 at 4:48:45–4:49:26.)3
 The officers drove him
to the back of the Whipple building and returned him to a holding cell. (Doc. No. 21 ¶¶ 8–
9; Doc. No. 25 ¶ 5.) During this encounter, officers dislocated Pablo F.’s shoulder. (Doc.
No. 21 ¶ 7.)4
Pablo F. now bringsthis Motion seeking to enforce the Court’s Order granting
the Petition.Again, Respondents make no attempt whatsoever to support their assertion that
Pablo F. was released. Absent any such argument, the Court cannot agree that a reasonable
person would have felt free to leave when exiting the detention facility and immediately
being stopped by ICE officers. Likewise, absent some argument, the Court necessarily
concludes that Pablo F. was subject to restraints not shared by the public generally when
he took one step outside of the detention facility and was immediately stopped by ICE
officers who forcibly returned him to a detention cell. Because Respondents do not make
any legal argument that Pablo F. was ever meaningfully released from custody, the Court
grants the motion and orders Pablo F.’s release.6
6 To be clear, Pablo F. is not arguing, and the Court is not concluding, that an order of
release in a habeas matter renders unlawful any future arrests. Rather, the Court reaches
the narrow conclusion that because Respondents advance no legal argument in this case to
support their assertion that Pablo F. was released from custody, and because the
uncontested facts show that ICE officers immediately swarmed Pablo F. as soon as he
stepped out of the building, Pablo F. was not released from custody.

Like the anti-woke backlash of which it's part, the whole "campuses as hotbeds of left-wing radicalism" discourse willfully confuses the noise for the signal. Most people go for a job credential and leave deeply socialized into the protocols of power, of which violence against women is central.

If the concept of Rights stands for anything it's that a person can't be summarily rendered out of the country and into torture—and the right-wing justices don't just reject this, they perceive the lower federal courts who *do* believe in Rights as engaged in a sort of rebellion against them

The hype and excitement among the legal AI boosters is starting to wear off it seems. Seeing a lot more LinkedIn posts like this of late.
I always thought that the rise of Al in law would be a great thing. I now think I may have been wrong.

Somewhere this morning a trainee is doing a first-pass document review that an Al could have finished before they got their coat off.
Everyone agrees this is progress. I'm not sure it is.

The grunt work is how lawyers learn. You read four hundred bad contracts and somewhere around number three hundred you start spotting the one that's wrong before you can explain why. Nobody taught you that. You got it from the volume.

Take the volume away and you still get a qualified lawyer at the other end. You just get one who never built the instinct, and who now has to supervise a machine doing a job they've never done themselves.
Firms are automating the bottom of the pyramid and assuming the top will look after itself.

I don't think it will. I think in about ten years we find out what a generation of lawyers who never did the boring bit actually looks like.

"It's almost like a constitution, in a way," Mr. Trump said while flanked by SpaceX's Elon Musk, Meta's Mark Zuckerberg, Anthropic's Dario Amodei, Nvidia's Jensen Huang, OpenAI's Greg Brockman, Google's Sundar Pichai and a throng of other tech executives."It's not clear exactly how the accord will work. Meta CEO Mark Zuckerberg told reporters the AI firms agreed to "multiple layers of auditing and controls," including internal evaluations and external audits. The findings of auditors would be independently reviewed by each company's board of directors, Zuckerberg added.
