On DOJ's effort to get others arrested for the church protest. The Eighth Circuit — including two Trump appointees — denied DOJ's request to order the additional arrest warrants to be issued after the magistrate said no. [Note, though, that Judge Grasz's concurrence is a very limited denial.]
UNITED STATES COURT OF APPEALS FOR THE EIGHTH CIRCUIT
No: 26-1135
In re: United States of America
Petitioner
Appeal from U.S. District Court for the District of Minnesota (0:26-mj-00040-JMB)
JUDGMENT
Before KELLY, GRASZ, and KOBES, Circuit Judges.
Having considered the arguments of the United States and the response and supplemental response of the Chief Judge of the United States District Court for the District of Minnesota, the Emergency Petition for Writ of Mandamus or Issuance of Arrest Warrants is hereby denied. The mandate shall issue forthwith.GRASZ, Circuit Judge, concurring in the judgment.
I would deny the Emergency Petition, without prejudice, on the basis that while the district court has acknowledged it has authority to review the magistrate's refusal to sign the warrants, see 28 U.S.C. § 636 (b)(1)(A)("A judge of the court may reconsider any pretrial matter under this subparagraph"), the Complaint and Affidavit clearly establish probable cause for all five arrest warrants, and while there is no discretion to refuse to issue an arrest warrant once probable cause for its issuance has been shown, Ex Parte United States, 287 U.S. 241 (1932); see
also United States v. Santtini, 963 F.2d 585, 593-596 (3d Cir. 1992), the government has failed to establish that it has no other adequate means of obtaining the requested relief.

Footage taken moments before a struggle shows that the man was filming, holding a phone in his right hand, backing up. His left hand is up, visible, palm facing out, as he backs away from the area. An agent uses his right hand, on the torso of the victim, pushing him back, while the man complies.

Some perspective: The S&P opened down -1.3% on Trump's Greenland saber-rattling. That's $750 billion of wealth destroyed -- roughly equal to estimates of the value of Greenland. And so ~in dollar terms~ his shenanigans have already cost the US one Greenland, and we've got nothing to show for it.

This makes facially neutral policies--like poll taxes and literacy tests--that we know were adopted for discriminatory purposes legal. Organizations can now simply claim there was no discriminatory intent regardless of outcome. It's unconstrained institutionalized racism.

I know it's all so stupid, but this isn't why it's DoD. Army/War and Navy being separate was outdated and impractical, needed to unify. "Defense" as a common name for that started w/ "Minister of Defence" in the UK, created for the same reason by notoriously woke war-loser Winston Churchill.

King’s point is that it didn’t work because Trump was cutting SNAP benefits. But lower courts had required Trump to pay full SNAP, and while Trump *probably* would have won at SCOTUS, that outcome wasn’t guaranteed and would have been known soon anyway.
