Yeah, especially since in Canada you've only got MAID. Which I'm not trying to be snarky about. I don't entirely know how/why the U.S. approach to the carceral system is so different from those in Canada and the UK. Probably slavery is a big part of it. It usually is.

It certainly seems like it was ineffective for an 18 year old to be sentenced to death… but I’m far from an expert and also can’t believe the US still has the death penalty in so many states.

There's more than a little suggestion that Christa Pike received ineffective counsel even though both Tennessee and the federal courts denied her appeals requests with that allegation. Partly this is just that there's an extremely high threshold for an appeal to be successful.

I honestly don't know. The judge might instruct the jury to disregard. Jesse Mack Butler's case was in Oklahoma, not Tennessee. Different judicial system. And different life circumstances.

Correct me if I’m wrong but a lawyer can still make an argument for the young age to be a factor in sentencing could they not? I keep thinking about Jesse Mack Butler and how he got away with community service for violent rape and strangulation.

Not in the U.S. Eighteen is the age of majority. Also it does depend a lot on jurisdiction. The murder was a state case, not a federal case, so it would've been about what the Tennessee state guidelines were.

I know that but there are so many cases involving torture that do not receive the death penalty… and being 18 would usually be a mitigating factor. I’m in no way excusing what she did but I’m just wondering what the legal precedent and arguments are.

Short answer is the death penalty isn't reserved for 'the worst of the worst' or a measure of culpability. It's reserved for defendants who pull a prosecutor willing to seek it with a jury willing to impose it in a jurisdiction willing to grant it. It’s a sick, arbitrary lottery of state violence.

That was my other concern … how good were her lawyers. Because it seems like in the US the calibre of lawyer you have matters a ton. I can’t stop thinking about Jesse Mack Butler who raped and strangled two children and video taped it but his wealthy family were able to get him treated as a minor
