Without warning or consultation, Congress just received an $810 million package of pocket rescissions from the Administration. This is the most recent attempt by this Office of Management and Budget (OMB) to undermine Congress's Constitutional power of the purse.
This move shows that OMB intentionally withheld these funds for months to execute this unlawful cancellation of appropriations that were approved on a bipartisan basis and signed into law.Not only is the delay itself an impoundment that was not reported to Congress, but also it is a usurpation of Congress's appropriations powers.
OMB is an agency of the executive branch. It does not get to decide which programs are worth funding.
The independent Government Accountability Office has concluded that pocket rescissions are unlawful and not permitted by the Impoundment Control Act. Any effort to rescind appropriated funds without congressional approval is a clear violation of the law.
I will work with my colleagues to address these illegal actions.

What about the Hatch Act? Trump is exempt from the Act, but presumably other federal employees involved in creating the ad are not. But the problem again is enforcement. Trump fired the Office of Special Counsel which now has no confirmed leader and has stopped enforcing the Act for Trump officials.
Appropriations law is hardly the only tool Congress has created to police political activity by employees of the executive branch. The Hatch Act, passed in 1939, limits political activities by nearly all federal civilian executive-branch employees. Among many other things, it prohibits all covered employees from using their “official authority or influence for the purpose of interfering with or affecting the result of an election” and “engaging in political activity while on duty; on federal property”. To enforce the Hatch Act, the US Office of Special Counsel (OSC) renders advisory opinions and can investigate and prosecute alleged violations.

Microsoft has around 2GW of AI compute, yet it's announced on each of the last three quarters that it's brought a gigawatt of capacity online. It's very clear that it's misleading the public about its capacity - and data centers are massively delayed. www.wheresyoured.at/wherere-all-...
In earnings calls for its second, third, and fourth quarter fiscal year 2026 earnings, Microsoft would use near-identical phrasing:

Satya Nadella, Q2 FY26 (January 28, 2026) earnings call: All up, we added nearly one gigawatt of total capacity this quarter alone.
Satya Nadella, Q3 FY26 (April 29, 2026) earnings call: All up, we added another gigawatt of capacity this quarter, and remain on track to double our overall footprint in just two years.
Satya Nadella, Q4 FY26 (July 29, 2026) earnings call: All up, we added another gigawatt of capacity this quarter and remain on track to roughly double our overall capacity in just two years.
While I cannot say the exact rationale for making these statements, I can find no way to interpret them other than being an act of deception. I already anticipate the response here will be that what Microsoft said here is “legal,” because it never said that this was AI capacity, but anyone responding like this operates with a peasant’s mindset. Anyone reading this transcript or hearing Microsoft mentioning that it added “gigawatts” of data center capacity is thinking about AI data center capacity — as evidenced by this piece and this piece and basically everyone you talk to on the subject.

Eric Oliver: Yeah. A player piano is not musical. It’s a player piano. In that sense, it’s not generating its own music. [00:34:00] It’s funny; it even starts with this Cartesian notion of “I think, therefore I am.” Well, if you didn’t have a word for think, then would you not exist?

I mean, that starts with the same linguistic fallacy: that cognition somehow has to be understood only if it’s oriented in some lexicon of words. And that’s one aspect of our type of cognition, but it’s not cognition in its totality.

And I think there’s a lot of misunderstanding in terms of what consciousness is. Our willingness or eagerness to ascribe consciousness to, say, LLMs also reveals what our own brains do with respect to consciousness, because our sense of self is a model that our brains are creating. I’ll maybe situate this in another way. We oftentimes think that the way we perceive the world works like this: I just open my eyes and the world [00:35:00] comes to me through my senses, and then my brain is there processing all this incoming information and kind of creating a scene.

It’s not really what’s happening. What happens is that in the moment before I open my eyes, my mind is already generating a prediction about what it thinks the world is going to be like, and then this information comes in and basically updates and varies that prediction relative to the incoming information.
