On April 8, 2014, the Court of Justice of the European Union (CJEU) handed down its decision in Digital Rights Ireland (joined cases C-293/12 and C-594/12), striking down the EU's Data Retention Directive as invalid. The Directive had required telecoms in member states to retain user metadata — phone numbers, IP addresses, location data, device identifiers — for six months to two years, on every customer, with police access on a production-order standard. The CJEU found this regime to be a "particularly serious" interference with the fundamental rights to private life and personal data protection under Articles 7 and 8 of the EU Charter, and that the interference failed proportionality because (1) the retention applied to all persons without distinction, (2) there was no relationship between the retained data and the threat the regime was meant to address, and (3) safeguards on access were insufficient. Really important piece that gets to the heart of this—delays in Canadian immigration systems mean more people waiting, means more people on the IFHP, means cutting the IFHP instead of addressing delays will lead to serious harm for refugee claimants in Canada.
“People are going to die because of this, and the government doesn’t care,” added Maheen Hyder, a mental health and trauma therapist working with refugee claimants.
The IFHP cuts are expected to save the government $231.9 million annually. Program costs have ballooned due to a larger number of claimants and lengthy delays at the Immigration Refugee Board. But instead of prioritizing spending toward clearing that backlog, the government changed the law to make it more difficult to claim asylum and is now cutting health care benefits.

The governing Liberals will obviously accept whichever warm body comes its way on its slow march to a majority. But accepting someone like Ms. Gladu into its caucus perpetuates the Liberals’ reputation as a party without foundational principles: as one where the desire to govern is, in fact, its primary ideological driver. That explains how the Liberals can oscillate so wildly on major issues – on carbon taxes, on immigration, on resource extraction and development – and how it can accept someone like Ms. Gladu on one end of the political spectrum, and someone like former NDP MP Lori Idlout on the other.
