Court expansion is rapidly becoming the median position among Dem electeds and Dems won’t nominate anyone for president who’s against it. The SCOTUS Republicans made something that hasn’t been done since Reconstruction mainstream. They did this to themselves.

Similarly, people keep asking me if immigration will get much better if Democrats retake Congress and the answer is "probably not." ICE is largely insulated from Congressional pushback (the 2026 budget reconciliation bill funded them through 2029) and hearings and subpoenas can only do so much.

The only way to read the text of the statute, which is clear and unambiguous, is in a way contrary to how it’s been read by immigration advocates and hawks alike, the DOJ, and the overwhelming majority of judges for three decades. -Alito (either for the majority or the dissent)

I am less pessimistic about this than I am about the third-country removal case, but I have no illusions that this is an easy case for advocates. But this is a situation where nearly every federal judge in the country has already weighed in, and the vast majority have rejected Trump's views.

A victory for the government in this case would greenlight long-term mass civil detention at a level not seen since Japanese internment during WWII. It would represent the largest change in how the US treats immigrants facing removal since 1996, and remind us again that the 96 law must be erased.

This will be one of the most important immigration cases in a generation. The Trump admin claims that a 1996 law mandates the detention of millions of people without any right to a bond hearing; every person who entered illegally, no matter how long in the past. If they win, it's a nightmare.

If you don't win you can't do policy. Feeling morally cozy and purity preaching online is not a policy. Focus pragmatically on winning and then use the power you gain from winning to construct effective legislation. That is what yields actual positive outcomes for the people that live here.
