There are two organizations that I care most deeply about: Stanford University, where I grew up, went to college, learned to do science, and met my wife; and NIH, where is spent the most satisfying years of my professional life. Bhattacharya has managed to become an embarrassment to both.

Judge Young's order has come in. Grant terminations in the plaintiff states or to the plaintiff orgs (APHA, UAW) are officially void and illegal. It also says that the "Challenged Directives" are arbitrary and capricious — and thus illegal as well. Now what exactly are are these directives? 🧵

Because on this record anyway, I don't see anyone pushing back against it. Take a look at the people who have been named as defendants here. One of them is a cabinet-level officer. The other is not the same individual, but is now the director of the National Institutes of Health [Jay Bhattacharya].

Wondering if your grant will be reinstated from Monday's ruling? Check here. Plaintiffs have uploaded a list of 848 (of the ~2400 total terminated) they say are covered because they're to institutions in the states aforementioned or a part of APHA/UAW. The judge must approve the list first.

Judge Young says he expects that the government will quickly comply with his order in this case. To clarify: he's vacating the grant terminations at issue. And wants the money to start flowing ASAP. Of note: the universe of grants "at issue" in this case is in dispute and will be litigated further

To be clear, Judge Young is ruling that the NIH terminations were neither "reasoned" nor "reasonable" based on the legal standard previously set forth by the Supreme Court for reviewing agency actions (e.g., terminations) under the APA. This is very good for plaintiffs.

Judge Young says he has concerns about discrimination against race, sexual orientation, and potentially women in this case. He asks if the plaintiffs will bring this up. Plaintiffs say the Public Health Service Act dictates that advancing the health of minorities and women is mandated by Congress.

Some notes: - At stake are hundreds of wrongfully terminated grants. We at grant-watch.us count about 1700. Most terminations at Harvard and Columbia are not included in these cases. - Defendants argue there are far fewer grants at issue in this case, i.e., just a few hundred.

Any guesses what will happen to all of us currently awarded K99/R00 MOSAIC, with NIH expiring the NOFO? NIH requires an application to transition to R00. Does the expired NOFO prevent them from accepting the R00 application?
