location information as cell phones. But it could still reveal a lot about a
person’s whereabouts, and it is easy to imagine the kinds of sensitive

It could show which doctor someone goes to or what lawyer’s office someone visits. It also collects mundane information about people’s commutes, but it collects a tremendous amount of such information all the time. But this leaves the question of why is it the government’s business where everyone goes all the time? The government cannot go snooping through our personal lives and business without an adequate basis to do so. That is what the Supreme Court has said since its decision in Katz through its decision in Chatrie this year, nearly sixty years later. It is not too much to draw the line at indiscriminate mass surveillance.

So, yeah, training wasn't fair use here - but they limited that to the facts, while drafting a copyright maximalist decision that simultaneously makes fair use less accessible to those who need it the most. Great decision for publishers, horrible for creators.

As bad if not worse: the court also appears (by my read) to have held, for all intents and purposes, that the headnotes are individual works - at least for assessing the 3rd factor. Breaking works down like that artificially shrinks the work, making the 3rd factor favor fair use less often.

There simply are not more than a handful of ways to draft effective headnotes; good headnotes *must* closely mirror the judge's language. Weakening this doctrine is a horrible outcome for this case.

In particular, the holding that headnotes are protectable notwithstanding the merger doctrine is atrocious. (For nonlawyers, headnotes are 1-2 sentence summaries of key points, and the merger doctrine holds that if there are a very limited number of ways to say something, it's not protectable.)

I cannot get my head wrapped around how terrible an idea protecting individual headnotes is. If a headnote is not extremely similar - not just substantially, extremely - to the language it relates to, it is literally worse than useless. Protecting them is utterly bonkers.

Update on letting Muse run Facebook Marketplace for me.
So I’ve spoken to 
@davidsingleton
 and the Muse team tonight and we went through the log to figure out what went wrong. Regarding the address leak. The first thing that popped up from Muse when asking it to handle my Facebook marketplace was an option with ‘Allow One Time’ or ‘Allow Always’. I clicked the latter thinking it would still send approvals to accept offers later down the line (it didn’t so be careful).

By doing that it granted Muse permission to send messages on my behalf going forwards using a template it put together using information it asked from me. Which also included the pickup address that I did give to Muse (again I didn’t think it would send it out to everyone that gave me an offer so it’s worth checking). I mentioned to the meta team it could be easily overlooked as it was with me and they said they will be making this more clear moving forwards.

Regarding the lowball offer situation. It accepted an offer of $600 and sent out my address to a buyer to come collect the item after I strictly set a minimum of $700 with Muse. The Meta team informed me this was an error on their end which caused a display issue removing the ‘7’ from the output to the buyer. And with it stating “Sounds good, 00 it is!” after the buyer asked for $600 it made it look to the buyer like his offer was accepted.

I suggested to Meta that each message sent by Muse should have a little “Sent By Muse” badge underneath so everyone knows it wasn’t sent by a human as there was really no way of knowing who sent what in the chat which is very concerning.
As for the buyer, we made up and he even came by tonight to buy something else. All ended well.
