As I explained the last time this dumb argument made the rounds, if Congress was never allowed to change the Court’s size (something it’s done seven times), that would mean four of the *current* justices (all of whom are Republicans) hold unconstitutionally created seats: www.ms.now/opinion/repu...

Republicans say court packing is 'unconstitutional.' They're wrong.
The argument that court expansion is unconstitutional is weak, transparently political — and most importantly, wrong.

That disposes of the specific charge that research that Fauci’s agency funded produced the virus. It did not.

The new racist double standard set up by Alito in the TPS ruling: if there’s any other motive in addition to the racism, the racism doesn’t count, but if the state wants to *prevent* discrimination against black people, that is racist and unconstitutional www.theatlantic.com/ideas/2026/0...
The Roberts Court has been turning anti-discrimination law upside down for years. Its approach came into particular focus in May, with Louisiana v. Callais, in which it determined that not allowing Louisiana’s government to dilute Black votes was racist. In that case, Alito insisted that forcing the state to draw a second majority-Black congressional district would be an “unconstitutional racial gerrymander” because Republicans were entitled to discriminate against Black voters if they argued that their purpose was partisan instead of racist. The Court reaffirmed that position in a subsequent case dealing with Alabama, after a lower court had found ample evidence of deliberate racial discrimination, as opposed to the discriminatory effect of the Louisiana map.

Mullin now sets up an even more impossible double standard. If the government wants to discriminate against Black people, any pretext will do. “As long as there is a plausible basis—any plausible articulable basis—for the government’s action, then the Court will look to that basis as sufficient,” Aderson Francois, a law professor at Georgetown University, told me, “even in the face of evidence that government actors were motivated by animus.” If a Black person wants to prove they’ve been discriminated against, however, no amount of evidence will suffice.

Pictured are the two most flawed paragraphs in Callais. SCOTUS declares that *it*—and not Congress—gets to decide what legislation is "appropriate" under the Fourteenth and Fifteenth Amendments. Which is how we come to today's SCOTUS majority blessing racist gerrymanders bc the VRA is "colorblind."
Not only is this the best reading of the statutory text, but it also ensures that §2 of the Voting Rights Act does not exceed Congress’s authority under §2 of the Fifteenth Amendment. That provision confers the “power to enforce [the Amendment] by appropriate legislation.” Thus, to lie within Congress’s authority, §2 of the Voting Rights Act must “effectuate by ‘appropriate’ measures the constitutional prohibition” in §1 of the Fifteenth Amendment. Katzenbach, 383 U. S., at 308. Our Fourteenth and Fifteenth Amendment jurisprudence delineates what constitutes “appropriate” legislation in the sense relevant here. See City of Boerne v. Flores, 521 U. S. 507, 518 (1997) (stating that Congress has “parallel power to enforce the provisions” of the Fourteenth and Fifteenth Amendments). In legislation enforcing these Amendments,

To understand what the Supreme Court is doing, you have to recognize that this is how authoritarians in Hungary, Turkey, and Venezuela consolidated power. Scholars call it autocratic legalism. The Court isn’t complicit. It’s an active participant. Roberts is following a script.
The conservative majority has learned to use anti-discrimination language as the vehicle for preserving discrimination. Justice Kavanaugh’s suggestion that remedies for racism must have an “end point” inverts the logic of the Reconstruction Amendments. They were written to empower Congress to act against racial domination, not to set an expiration date on equality. This will be the Roberts Court’s legacy: using the Constitution not to expand freedom, but to protect established hierarchies. The Court has simply found a new minority to protect—not racial or religious minorities, but a political party whose power endures through structural advantage, even when it commands fewer votes.Where the Court has shown the greatest deference is to power itself, culminating in the decision granting Donald Trump sweeping legal immunity for “official acts”—a ruling that defies global democratic norms, where dozens of presidents and prime ministers have been prosecuted and convicted of crimes in recent years. The Court is thus working on two fronts: shielding the leader of the anti-democratic movement from accountability while simultaneously dismantling the electoral rules that allow the majority to vote his party out.

Lots of details in this piece that have flown under the radar. According to DiGenova himself: (1) Bondi previously nixed his appointment to run the FL probe (2) Bondi was fired over Trump’s frustration w/ the slow pace of the case (3) Trump personally asked him to lead the investigation
= Menu
LAWFARE
DiGenova has also been willing to pull back the curtain on the palace intrigue surrounding his recent hiring: Just this month, in an interview with Rudy Giuliani, diGenova claimed that former Attorney General Pam Bondi was "singularly responsible for the delay and investigations into the lawfare against Donald Trump that's being run out of the...U.S. attorney's office in Miami and Ft. Pierce." Saying she had previously nixed his appointment to run the probe, diGenova insisted, "If she had not done that, we would have had indictments brought in the last two months."
DiGenova further suggested that Bondi had been fired over the president's frustration with the slow pace of the Miami probe."The president's conversation with her yesterday coming back from the Supreme Court was not pleasant," he said, referring to the conversation in which Trump reportedly fired Bondi. "The president was ripping mad about the fact that there was no progress on the lawfare investigation in Miami."
On April 20, the same day he was sworn in, diGenova appeared on WBAL Radio and said the president "personally asked" him to accept the role running what he called "the Russia hoax investigation." Later-sketching out the Grand Conspiracy in full—he noted "the historical significance of what happened in 2016, 2020 and 2024, where it's very evident...that there was a very brazen plot against a private citizen, and then a president, and then a post-president, and then a sitting president again, Donald Trump, to deny him his civil rights."

From “The Simpsons” house genius John Swartzwelder, interviewed in The New Yorker by Mike Sacks
It's the only way I know how to write, darn it. But I do have a trick that makes things easier for me. Since writing is very hard and rewriting is comparatively easy and rather fun, I always write my scripts all the way through as fast as I can, the first day, if possible, putting in crap jokes and pattern dialogue-
"Homer, I don't want you to do that."
"Then I won't do it."Then the next day, when I get up, the script's been written.
It's lousy, but it's a script. The hard part is done. It's like a crappy little elf has snuck into my office and badly done all my work for me, and then left with a tip of his crappy hat. All I have to do from that point on is fix it. So I've taken a very hard job, writing, and turned it into an easy one, rewriting, overnight. I advise all writers to do their scripts and other writing this way. And be sure to send me a small royalty every time you do it.
