Rahm’s anti-left views are held by many center-left elites in media and politics. And he is pretending to run for president in 2028 (doubt he actually runs because he knows his odds are very low.) So interviewing him can be framed as “news” and he bluntly makes anti-left points centrists agree with.

The fact they’re arresting people who are assembling peacefully instead of the federal agent who just executed one of their residents is pathetic. Up to this point I have been pretty careful not to get to this point rhetorically but we’re over the edge, there’s a burden of responsibility.

NB: When I, a professor of law, profess that an act is unlawful, I am not doing it to inform the lawbreaker, but rather to inform you, the reader. So the question “what, like you think he cares?” is inapposite. The question is whether *you* care. I think you should, which is why I bother.

If a federal judge, appointed by Trump, can call him “simply untethered to facts,” our White House press corps can as well. storage.courtlistener.com/recap/gov.us...
In sum, the President is certainly entitled "a great level of deference," Newsom II, 141
F.4th at 1048, in his determination that he "is unable with the regular forces to execute the laws
of the United States." 10 U.S.C. § 12406(3). But "a great level of deference" is not equivalent to
ignoring the facts on the ground. As the Ninth Circuit articulated, courts must "review the
President's determination to ensure that it reflects a colorable assessment of the facts and law

within a 'range of honest judgment.'" Id. at 1051 (quoting Sterling, 278 U.S. at 399). Here, this
Court concludes that the President did not have a "colorable basis" to invoke § 12406(3) to
federalize the National Guard because the situation on the ground belied an inability of federal
law enforcement officers to execute federal law. Id. at 1051-52. The President's determination
was simply untethered to the facts.

Michigan AG Dana Nessel comes out swinging against University of Michigan for stopping care for trans youth.
Alt text: Letter from the Michigan Attorney General, Dana Nessel, dated August 26, 2025, addressed to Michigan healthcare providers and patients. The letter discusses the federal government’s executive order attempting to limit access to healthcare and withhold federal funds from facilities that must provide nondiscriminatory services. Nessel reminds providers that federal funding availability does not change Michigan’s obligation to prohibit discrimination based on protected classes, including gender identity. She emphasizes that withholding services from transgender individuals while providing them to cisgender individuals constitutes illegal discrimination under Michigan law. The letter explains that her office has acted swiftly, joining lawsuits to challenge federal attempts to restrict access to care, including a pending case against efforts to deny gender-affirming care for people under 19. Nessel reaffirms her commitment to ensuring Michigan residents’ full access to healthcare services and federal funds, free from discrimination. The letter is signed “Dana Nessel, Michigan Attorney General.”

Under pressure from the White House, the Smithsonian has removed Trump from the impeachment exhibit at the History Museum. The exhibit now says that “only three presidents have seriously faced removal,” referring to Johnson, Nixon, and Clinton. The exhibit now looks the way it did in 2008.
