There is a truism in campus sexual violence advocacy that schools can violate students’ rights because they can reset the movement every four years. On the flip side of that, there is also a new cohort of students every four year who still believe rape is wrong and expect better of their schools.

For every story like the Cornell gang rape, there are thousands more that couldn’t make it into the light. I wrote about a few dozen of them at one university in On the Wrong Side. The university’s treatment of survivors is eerily similar to what Jane Doe at Cornell experienced.

And that brings us to present day. The most reliable way for a campus sexual assault story to make it into a newspaper is for the survivor to file a lawsuit against their school. And the two main vehicles survivors used to do that have been closed for years.

In a Title IX context, “emotional damages” was interpreted to mean any damages resulting from trauma. That decision is in a long legacy of treating women as “hysterical” for being hurt by sexual violence.

And in 2022, SCOTUS ruled on an ADA case with huge ramifications for Title IX. In Cummings v. Premier Rehab Keller, PLLC, SCOTUS ruled that even if an individual’s civil rights are violated, they cannot seek “emotional damages” from the discriminating institution.

At the time, the draft received an unprecedented amount of comments raising concern about violations of survivors’ rights and the risk of turning Title IX into a vehicle of gender discrimination. They were systematically ignored. Only pro-perpetrator recommendations were accepted.

Trump rescinded prior guidance on Title IX during his first year in office, then put out a new regulation that experts warned would retraumatize survivors and offer perpetrators impunity. It literally had provisions designed to allow confessed perpetrators to get away with rape.

The main reason you haven’t heard about campus sexual violence in a few years is because Trump and SCOTUS have made it much, much harder for survivors to come forward. You might vaguely remember that Title IX was a big battleground in his first term. And that we lost.

Trump’s Title IX regulation went into effect in 2020, where it received almost no media coverage during the pandemic. There were also few students on campus to participate in or protest the process. Schools went above and beyond in implementing hostility toward survivors.

There was also a sense that Trump losing re-election would fix everything. But Biden dragged his feet on undoing the damage of Title IX. And then HE lost re-election and his Title IX regulation was vacated before it ever really went into effect.

absolutely fucking incredible news for public health in canada that a safer supply organization successfully fought the constitutionality of drug possession trafficking laws for not providing any legal way to operate. selfless life-saving work that is actually being identified and respected as such.

But in her judgment on their constitutional challenge on Tuesday, Murray concluded that a non-medicalized safer supply program is urgently needed to save lives.

And with no legal source of drugs available for such a program, and no legal "safety valves" in the CDSA that would support setting one up, she found such a program "is legally and practically incapable of being exempted."

She said part of the CDSA "unjustifiably infringes" on two parts of the Charter of Rights and Freedoms, and deprives DULF members the "right to life and security of the person."

She gave Parliament six months to find a way to allow for a "pathway to non-medicalized safer supply."
