COLD MOON OVER BABYLON by Michael McDowell is a haunting Southern Gothic tale of supernatural revenge. Goddamn, what a book to finish reading in Florida in October! McDowell's a genius that was taken from us too soon.

Full definition of homestead property here:
What Counts as “Homestead” Property in Florida?

In Florida, homestead is the primary residence of a person who lives there, protected by Article X, Section 4 of the Florida Constitution. It covers up to one-half acre inside a municipality (or up to 160 acres outside one) and must be owned by a natural person — not, for example, an LLC. Homestead status carries three separate benefits: protection from most creditors, a property-tax exemption, and special inheritance rules. This article focuses on that third piece — what happens to the home when the owner dies. For the protection itself, see our guide to Florida homestead law.

In Florida, your homestead counts as protected homestead with the following qualifications:
For most Florida families, the homestead is the single largest asset. The interaction of Florida’s constitutional homestead protection with Medicaid estate recovery is the reason so many Florida residents come through long-term care Medicaid with the family home intact.

Three layers of protection apply:

During life, the homestead is exempt from the Medicaid countable-resource test. The applicant can own it and still qualify.
At death, if the homestead is protected homestead and passes to constitutionally protected heirs (spouse, descendants), it passes outside probate by operation of Fla. Stat. § 732.401(1).
Against creditors generally, the Florida Constitution’s homestead protection is, per the Florida Supreme Court in Snyder v. Davis, 699 So. 2d 999, 1001–02 (Fla. 1997), to be “liberally construed in favor of maintaining the homestead property.”

Put together: when a Florida homestead descends to a constitutionally protected heir, AHCA cannot reach it through § 409.9101 recovery.

In Florida, Medicaid cannot touch non-probate assets. Look at all the options you get:
Lady Bird Deed on the homestead. Transfers by operation of law at death, outside probate, outside recovery. See our Lady Bird Deed guide.
Revocable living trust for non-homestead assets. Assets pass under the trust, not through probate. See revocable vs. irrevocable trusts.
Beneficiary designations on retirement, life insurance, and bank accounts. Named beneficiaries receive funds outside probate.
Joint titling with rights of survivorship where appropriate (considers spouse status and homestead rules).
Qualified Medicaid annuities for excess assets, where properly structured.
Miller Trust (QIT) for excess income does not affect recovery directly but enables qualification in the first place. See our Miller Trust guide.

People use "transmed" frequently to accost trans women encouraging medical transition in the face of persecution and death. But this is not that. This is definitionally transmedicalism.
Transmedicalism
(noun | transmedicalist, adjective)
Transmedicalism is a belief that buys into both biological essentialism and the medicalization of transgender people. Transmedicalists believe that in order to be trans, one has to not only experience dysphoria, but also pursue medical intervention to reduce that dysphoria. Some even go so far as to say that someone who hasn’t had surgery cannot be trans. All of this is categorically false, but that doesn’t stop TERFs from joining up with transmedicalists to harass non-op trans people. Sometimes transmedicalists refer to themselves as “true trans” or transmed. At the end of the day, they’re people attempting to gatekeep and identity police being transgender and that’s not okay.

e.g. Cypher knew to avoid certain people on Twitter because transmedicalists were using certain emojis to express their essentialist beliefs.

The alternative is Virginia using state funds to cover it...and it's refusing to unlike other Dem-led states.
While the litigation plays out, several states, including California, Maine, Massachusetts, New Mexico, and Oregon, have confirmed that they will be taking on the full costs to ensure that trans youth continue to have access to the care they need. However, as Transitics has now learned, two Democratic-led states—Arizona and Virginia—will be going in the opposite direction starting next Tuesday.

This is absurd! You were just praised in party circles for this so why?!
As of writing, DMAS has not directly notified patients, families, or the general public of the new policy, likely leaving doctors to inform Virginia trans youth that their care will no longer be covered. The state’s governor, Abigail Spanberger, has fought to repeal many other anti-trans and anti-LGBTQ+ policies—recently tearing up when announcing she killed her state’s restrictions on trans kids’ bathroom access in schools—which makes this decision even more of a mystery.

I wrote this post before reading it and sure enough!
“This Republican ad calling out welfare leeches uses a young white male named ‘Brad’ as the villain. Meanwhile, back in reality, women are significantly more likely to be on welfare than men. And black people are astronomically more likely to be on welfare than white people. So the number of single young white male ‘Brads’ abusing the welfare system is minuscule,” posted Matt Walsh. “Practically non-existent. But of course Republicans don’t have the balls to do this ad with ‘Shaniqua’ as the villain. Even though that would actually be an accurate portrayal of the problem at hand.”
