No explanation. None. It’s obscene. I keep remembering the 1679 habeas corpus act. It reacted to the king arresting people & without trial deporting them. It began: “for prevention of imprisonment beyond seas.” Without explanation, our current SCOTUS majority is undoing centuries of justice.

No. Universities do not have to be "in sync with the administration and what the administration is trying to accomplish." They are institutions of learning led by scholars who follow their research in search of knowledge. They support free inquiry and learning. They are not political pawns.

This is an unusual order for several reasons, suggesting the majority thought it necessary. This was issued: • after midnight • before the government even responded (perhaps most irregular) • while a Fifth Circuit request remains pending & • before a dissenting justice could finish their statement.

NEW: Another Skadden attorney has resigned in protest, citing the law firm’s decision to strike a deal with Trump. “Skadden is on the wrong side of history. I could no longer stay knowing that someday I would have to explain why I stayed,” the lawyer, Thomas Sipp, wrote in his resignation letter.
Resignation
Dear colleagues and friends,
I just spoke to many of you. Thank you for listening. I am writing to let you know that I am leaving this firm.
There was a time when my employment here was so unlikely. For much of my early childhood, I was not a good student. I struggled to focus in class and take anything (other than my friendships) seriously.
But even then, there was one subject I loved: history. I thought it was so wonderful to learn about all that came before me, about the triumphs and tragedies, about the moments of individual bravery and collective complacency. And I loved recognizing the patterns in the stories across time and space. This rhyming nature of history informed and continues to inform my deeply held belief-that self-evident truth-that all humans are created equal. And that our individual differences are the product of our times and circumstances, and that who we are is shaped by what we choose to do.
While learning about these stories, many of them avoidable tragedies, I would often imagine myself faced with the same dilemmas. What would I do if I was there? Would I do the right thing? It always felt like there was no way to know.<

Resignation
く
I believe, as I know many of you do, that what the current presidential administration is doing is wrong. That we are sliding into an autocracy where those in power are above the rule of law. Skadden's agreement with the Trump administration sent our country deeper down this descent.
I am sure some of you will question my decision and chalk it up to me being a young attorney too eager to throw his career away. I am sure there will also be those of you who will think of me as naïve.
But there was a time when I sincerely believed that this place was committed to its true pro bono causes and diversity initiatives, even though these things may not always be lucrative, because it believed these things would make the world, and this firm, a better place. Having held itself out as a champion for these values, for this firm to turn its back on them so suddenly and so easily was shameful. I am embarrassed to work here. How can Skadden represent others when it can't even stand up for itself? It has also become clear to me that this firm no longer tolerates open discourse. Ahead of Friday's announcement, the firm took preemptive action to silence critics by covertly limiting our access to firmwide distribution lists. This was a clear effort to silence criticism of the firm's decision.
The consequences of Skadden's agreement with the Trump administration go beyond our own firm. It legitimized behavior that threatens our democracy.
As lawyers, we have an obligation to uphold the rule of law. This responsibility does not end when profits are threatened by a burgeoning autocracy.
I am making this decision to leave even though I was happy here. I have made so many great friends at this firm and learned from many great mentors.
Thank you so much, I will miss you all dearly. And I am making this decision knowing that not everyone can leave as readily as I can, that many of you have families who depend on the income you earn here—I do not mean to shame you into leaving, only to explain my decision.
Skadden is on the wrong side of history. I could no longer stay knowing that someday I would have to explain why I stayed.
Sincerely,
Thomas Sipp

The Monday ruling that blocks DHS Sec. Kristi Noem's effort to end Temporary Protected Status for hundreds of thousands of Venezuelans in the United States is an important one for several reasons. storage.courtlistener.com/recap/gov.us...
I. INTRODUCTION
At issue is whether this Court should temporarily postpone actions by Kristi Noem, Secretary of the Department of Homeland Security, taken against over 600,000 Venezuelan nationals who have legal status to reside and work temporarily in the United States. The Secretary's actions will shortly strip nearly 350,000 of these residents of their protection under the Temporary Protected Status ("TPS") program, subjecting them to possible imminent deportation back to Venezuela, a country so rife with economic and political upheaval and danger that the State Department has categorized Venezuela as a "Level 4: Do Not Travel" country "due to the high risk of wrongful detentions, terrorism, kidnapping, the arbitrary enforcement of local laws, crime, civil unrest, poor health infrastructure."
https://travel.state.gov/content/travel/en/traveladvisories/traveladvisories/venezuela-travel-
advisory.html (last visited 3/30/2025). The unprecedented action of vacating existing TPS (a step never taken by any previous administration in the 35 years of the TPS program), initiated just three days after Secretary Noem took office, reverses actions taken by the Biden administration to extend temporary protection of Venezuelan nationals that have been in place since 2021.

From 91 professors at Harvard Law School: a letter to our students. tinyurl.com/letter-to-ou...
A LETTER TO HARVARD LAW SCHOOL STUDENTS
March 29, 2025
To our students:
We are privileged to teach and learn the law with you. We write to you today—in our individual capacities-because we believe that American legal precepts and the institutions designed to uphold them are being severely tested, and many of you have expressed to us your concerns and fears about the present moment.
Each of us brings different, sometimes irreconcilable, perspectives to what the law is and should be. Diverse viewpoints are a credit to our school. But we share, and take seriously, a commitment to the rule of law: for people to be equal before it, and for its administration to be impartial. That commitment is foundational to the whole legal profession, and to the special role that lawyers play in our society. As the Model Rules of Professional Conduct provide: "A lawyer is ... an officer of the legal system and a public citizen having special responsibility for the quality of justice."
The rule of law is imperiled when government leaders:
• single out lawyers and law firms for retribution based on their lawful and ethical representation of clients disfavored by the government, undermining the Sixth Amendment;
• threaten law firms and legal clinics for their lawyers' pro bono work or prior government service;
• relent on those arbitrary threats based on public acts of submission and outlays of funds for favored causes; and
• punish people for lawfully speaking out on matters of public concern.
While reasonable people can disagree about the characterization of particular incidents, we are all acutely concerned that severe challenges to the rule of law are taking place, and we strongly condemn any effort to undermine the basic norms we have described.
On our own campus and at many other universities, international students have reported fear of imprisonment or deportation for lawful speech and political activism. Whatever we might each think about particular conduct under particular facts,…

Skadden Resignation
Today the executive partner of my former firm sent us all an
"update" that attempted to convince some of the best minds in the legal profession that he did us a solid by capitulating to the Trump administration's demands for fealty and protection money. Fellow Skadden attorneys: If you agree with Jeremy London's position that the firm should not engage in "illegal DEI discrimination," should devote prestigious Skadden Fellows to the Trump administration's pet projects, and should help "politically disenfranchised groups who have not historically received legal representation from major national law firms," (taking into account the robust pro bono work that major national law firms already do), then by all means continue working there. But if that email struck you as a craven attempt to sacrifice the rule of law for self-preservation, I hope you do some soul-searching over the weekend and join me in sending a message that this is unacceptable (in whatever way you can). As one of my more eloquent former colleagues put it:
"Do not pretend that what is happening is normal or excusable. It isn't."
There is only one acceptable response from attorneys to the Trump administration's demands: The rule of law matters.
The rule of law matters. As an attorney, if my employer cannot stand up for the rule of law, then I cannot ethically continue to work for them.

NEW: The Justice Department asks the Supreme Court to vacate the lower court orders blocking its deportation of alleged Venezuelan gang members to a prison in El Salvador—making some pretty dubious and unsupported claims about the alleged dangers of the orders. www.documentcloud.org/documents/25...
Yet even before the Proclamation’s public issuance, the district court halted
the imminent removal of five identified plaintiffs (respondents here) without even
hearing from the government. App., infra, 147a. Hours later, the court enjoined all
further removals under the Proclamation of TdA members after hurriedly certifying
a putative class of “[a]ll noncitizens in U.S. custody who are subject to” the Proclamation “and its implementation.” Id. at 148a. That order is forcing the United States
to harbor individuals whom national-security officials have identified as members of
a foreign terrorist organization bent upon grievously harming Americans. Those orders—which are likely to extend additional weeks—now jeopardize sensitive diplomatic negotiations and delicate national-security operations, which were designed to
extirpate TdA’s presence in our country before it gains a greater foothold. The government sought immediate relief from the D.C. Circuit, which took the extraordinary
step of hearing argument within days and issuing 93 pages of opinions. Id. at 1a-93a

WilmerHale was polite, professional, and direct. BigLaw could learn. Now, WilmerHale needs to actually fight this thing out. These orders are blatantly, insanely unconstitutional.

The DC Circuit’s decision upholding Judge Boasberg’s TRO against the lawless deportations of Venezuelans to El Salvador by Trump & Co was ironclad. Both Judge Millett and Judge Henderson wrote magnificent opinions. Judge Walker dissented — in a lame opinion. media.cadc.uscourts.gov/orders/docs/...
