Nation Files Emergency Injunction with the Circuit Court of Appeals

SELLS, Ariz. - The Tohono O'odham Nation has been informed by U.S. Customs and Border Protection (CBP) that it intends to remove thousands of Saguaros and other vegetation in its misguided efforts to construct a border wall. On Monday, Oct. 12, federal contractors will begin ripping out these protected plants that have lived in the Sonoran Desert for thousands of years. The fact that this desecration will take place on Indigenous Peoples' Day is disrespectful to all tribal nations.

In addition, earlier this week the Tohono O'odham Nation filed an emergency injunction with the Washington, D.C. Circuit Court of Appeals to stop DHS from removing thousands of sacred saguaros on Tohono O'odham land. Nation leadership is demanding that the courts put a stop to this lawless behavior that has already caused irreparable damage to our environment and cultural heritage, all in the name of constructing a costly and ineffective border wall. Known as ha:sañ, saguaros are symbols of the Tohono O'odham shared faith, serving as spiritual monuments to customs and values. The removal of any saguaro is an act of atrocity, as they are considered people by the Tohono O'odham."Trespassing on our land to remove the sacred saguaros is like having masked men break into your house and take away your children," said Tohono O'odham Nation Chairman Verlon Jose. "The ha:șañ are our family, as much a part of us as any blood relative. To destroy them by the thousands carves a wound in our hearts that will not heal. We call on all people for solidarity as we work to protect our culture and our land from this useless, destructive wall."

The mighty saguaro not only stands as an O'odham and American icon, it is also a critical part of our ecosystem, providing shelter, sustenance, and deep cultural significance. The saguaro, in Tohono O'odham custom, is akin to a person and any malicious action against one is as if harm is being done to our people. This belief is memorialized in Resolution 21-137 by the Tohono O'odham Legislative Council.

"This is a violation of our sovereignty, of our religious liberty, and of our land," said Chairman Jose. "The Nation will continue to fight to prevent this senseless devastation from going forward and we are grateful for the overwhelming community support we have received."

ENVIRONMENTAL AND FINANCIAL COST
Strubell et al. recently benchmarked model training and development costs in terms of dollars and estimated 퐶푂2 emissions [129].
While the average human is responsible for an estimated 5t 퐶푂2푒
per year,2
the authors trained a Transformer (big) model [136] with
neural architecture search and estimated that the training procedure
emitted 284t of 퐶푂2. Training a single BERT base model (without
hyperparameter tuning) on GPUs was estimated to require as much
energy as a trans-American flight.
While some of this energy comes from renewable sources, or
cloud compute companies’ use of carbon credit-offset sources, the
authors note that the majority of cloud compute providers’ energy is
not sourced from renewable sources and many energy sources in the
world are not carbon neutral. In addition, renewable energy sources
are still costly to the environment,3
and data centers with increasing
computation requirements take away from other potential uses ofgreen energy,4 underscoring the need for energy efficient model
architectures and training paradigms.
Strubell et al. also examine the cost of these models vs. their
accuracy gains. For the task of machine translation where large
LMs have resulted in performance gains, they estimate that an
increase in 0.1 BLEU score using neural architecture search for
English to German translation results in an increase of $150,000
compute cost in addition to the carbon emissions. To encourage
more equitable access to NLP research and reduce carbon footprint,
the authors give recommendations to report training time and
sensitivity to hyperparameters when the released model is meant
to be re-trained for downstream use. They also urge governments to
invest in compute clouds to provide equitable access to researchers.
When we perform risk/benefit analyses of language technology,
we must keep in mind how the risks and benefits are distributed,
because they do not accrue to the same people. On the one hand, it
is well documented in the literature on environmental racism that
the negative effects of climate change are reaching and impacting
the world’s most marginalized communities first [1, 27].6
Is it fair or
just to ask, for example, that the residents of the Maldives (likely to
be underwater by 2100 [6]) or the 800,000 people in Sudan affectedThese models are being developed at a time when unprecedented environmental changes are being witnessed around the
world. From monsoons caused by changes in rainfall patterns due
to climate change affecting more than 8 million people in India,9
to the worst fire season on record in Australia killing or displacing
nearly three billion animals and at least 400 people,10 the effect
of climate change continues to set new records every year. It is
past time for researchers to prioritize energy efficiency and cost
to reduce negative environmental impact and inequitable access
to resources — both of which disproportionately affect people who
are already in marginalized positions.

WHOA. This is big news. Mr. Soliman is a 31-year-old gay man from Egypt who came here at 3 with a green card. He lost his green card after a conviction, but an immigration judge found that he would be persecuted in Egypt and barred sending him there. He's locked in a hotel in Equatorial Guinea now.
A federal judge has ordered the Department of Homeland Security to return Ahmed Soliman to the United States, five months after he was expelled to Equatorial Guinea, a country where he has no ties, in a decision that could have far-reaching implications for thousands of others subjected to the Trump administration’s third-country removal scheme.

Arizona District Court Judge John C. Hinderaker, a Trump appointee, ruled that DHS violated the Due Process Clause of the Fifth Amendment and “must facilitate Plaintiff’s release from custody in Equatorial Guinea and return to the United States and must ensure his case is handled as it would have been had he not been improperly sent to Equatorial Guinea.”

Today, I resigned as Vice Chair of the ODP Pride Caucus. The state party expects us to be a sales team, censoring our voices when we beg candidates not to trade on trans lives. I am still a Democrat, but I will not value party approval over true, defiant advocacy. Full text below. 👇
Part 1 of an open letter of resignation by Arienne Childrey, stepping down as Vice Chair and member of the Ohio Democratic Party (ODP) Pride Caucus. She states that party leadership treats the caucus as a recruitment and sales team rather than a representative body. She cites an incident where the ODP censored and denied permission for the caucus to post a letter by two trans leaders addressing harmful comments made by Democratic gubernatorial candidate Amy Acton. The State Party Chair reportedly called the letter an "unwelcome distraction," which Childrey notes demonstrates how little party leadership values the voices and dignity of LGBTQ+ Democrats.
Since that decision, every Caucus plan, every potential post, and every path forward has been filtered through a lens of strict compliance and ODP approval. That may very well be the party's rule, but following those rules right now is a dereliction of our duty to the LGBTQ+ community.

For me, any rule that silences advocacy for the trans community during this time is an unjust rule, and I see no obligation to follow it. In alignment with the words of Dr. Martin Luther King, Jr. in his Letter from Birmingham Jail:

“One has not only a legal but a moral responsibility to obey just laws. Conversely, one has a moral responsibility to disobey unjust laws.”

We are living in incredibly dangerous times for the trans community. We are in an era where the GOP has so thoroughly weaponized trans lives that even some formerly self-professing allies within our own party have fallen prey to the rhetoric. Looking at the national trend towards Democratic anti-trans triangulation, as well as our own internal conversations, it is clear to me that this shift is much more than a simple coincidence.

We have to speak up—loudly, strongly, and unapologetically—or I fear what our 2028 choices may look like. The ODP would like everyone to believe they are a "big tent" party. However, their successful efforts to silence even the Pride Caucus—even in cases where we are simply begging our candidates not to trade on our lives for perceived electoral advantage—has proven otherwise. The tent hasn't gotten any bigger; it has simply shifted, leaving many trans individuals, progressives, and allies out in the rain.

I will continue to advocate, organize, and fight for our community with everything I have. But I can no longer compromise my own moral principles by remaining part of a caucus that appears more interested in party approval than in true, defiant advocacy.

If the lessons Democrats (& democrats) draw from DOGE is “right idea, wrong implementation,” we are doomed. Everyone involved in the unprecedented crime that was DOGE needs to go to jail forever, & Democrats need to rebuild all of the programs & agencies first, not do digital management consulting 🤦‍♂️
