IIRIRA remains one of the most authoritarian anti-freedom, pro-mass surveillance laws passed by the U.S. Congress in the last 50 years. A legacy of the height of "tough on crime" in the 1990s that is still shaping governance and freedoms today.
he Illegal Immigration Reform and Immigrant Responsi- bility Act (IIRIRA). The relevant IIRIRA provision, 8 U. S. C. §1373, contains two notwithstanding clauses. The U.S. now has an asylum cooperative agreement & another third country national deportation agreement with Honduras. Same situation w/ Liberia & Paraguay. ACAs throw asylum cases out of immigration court and other agreements deport anyone— including Afghans and Somalis—to anywhere. CHAOS

It used to be students didn’t know what the Cold War was, now have never known a time without DHS. More profoundly: I see my role as an historian working in policy to denaturalize the present. The way things are now are not how or always better than they’ve been or how they have to be in the future.
