Think this is BIG: A common stat was that the US was home to 5% (really 4.5%) of the world's pop but 25% of its prisoners. As of 2026, we are home to 4.1% of the world's pop ... and only 16% of its prisoners. Some of our 10-point drop is growing harshness elsewhere, but also our own declines.

My latest @ms.now, on ICE’s killing of Lorenzo Salgado Araujo in Houston, and on the striking degree to which the media has refused to just accept ICE’s narrative of things. The extent to which the NYT, WaPo, et al keep stressing ICE has no evidence of its claims seems like a real narrative shift.

Abstract
As more state supreme courts expand state constitutional rights against excessive prison terms, we can identify the various components of successful litigation. These include, for example, empirical historical research; a thorough mitigation record; social and neuroscientific evidence to show reduced culpability and the capacity for reform; and an amicus strategy that brings distinct but complementary perspectives. 

Another basic but often overlooked hurdle is choosing which legal test or tests to apply. What is the specific doctrine, in other words, that courts use to apply the broader concepts of “cruel” and/or “unusual”? By this I do not mean theorizing what “cruelty” ought to mean or how best to measure it, but rather how current law works in practice. More specifically, as state supreme courts expand rights against excessive punishments under state constitutional cruel and/or unusual punishment prohibitions, what are the legal mechanisms they use to do so? 

As it turns out, they are not all the same, and the various approaches can sow confusion. To provide some clarity, I have charted a taxonomy of successful state constitutional excessive punishment claims, with a focus on categorical rulings—that is, court decisions finding that certain punishment practices are necessarily excessive as applied to an entire category or group of people, not just one individual person. This taxonomy breaks down the tests and legal standards courts have used when expanding rights and how they apply to certain arguments and evidence, providing a roadmap for practitioners working to tee-up new or expanded categorical claims.I. This sums up the mayor’s approach to youth - policing & excluding youth is essential but providing youth w/ programming is an “unreasonable limitation.” The Mayor has had multiple years to create something more comprehensive & has not even tried to do so. I hope all CMs see this for what it is.
