Alito’s standard for racial discrimination in the TPS ruling, that racism has to be the *sole* motivation to count as discriminatory, is so deranged that it could arguably cover neither Jim Crow nor slavery. www.theatlantic.com/ideas/2026/0...
This is a “color-blind” Constitution that the architects of Jim Crow could love. Many of the devices employed during segregation, such as poll taxes, grandfather clauses, and literacy tests, were superficially race-neutral. In fact, slavery itself could conceivably be race-neutral—after all, one does not need to be a racist to seek cheap labor for a profitable business!

5th Circuit: A cop did not violate the Constitution when he shot (and nearly killed) an innocent man who had just disarmed the actual shooter whom police were there to stop www.ca5.uscourts.gov/opinions/pub...
LESLIE H. SOUTHWICK, Circuit Judge:
This is a tragic case of mistaken identity. A police officer believed he was targeting a gunman who had been firing on police from a residence.
Instead, he shot and badly wounded a man who had disarmed the actual shooter and then emerged from the residence holding the weapon. The issue here is whether that officer's mistake led to a violation of the victim's constitutional rights. As lamentable as these events certainly were, we agree with the district court that no constitutional violation occurred on the specific facts of this case. The district court denied relief. We AFFIRM.
