Like, what do we even do with this from McClesky v Kemp, in which SCOTUS basically says "if we accept that the death penalty is racially biased, we may be forced to confront the fact that the whole system is racially biased, and we can't do that, so ... the DP is fine. Fine. IT IS FINE."
Two additional concerns inform our decision in this case. First, McCleskey's claim, taken to its logical conclusion,

Thus, if we accepted McCleskey's claim that racial bias has impermissibly tainted the capital sentencing decision, we could soon be faced with similar claims as to other types of penalty. [Footnote 38] Moreover, the claim that his sentence
