And anthropomorphizing tries to provide legal cover: If AI goes 'rogue' - if it is an actor - then can the AI company be said to be the proximate cause of the rogue AI agent's harms?

That's because police officers have agency. Computer programs don't. If a computer program does something bad, it's because the computer programmers did something bad when they created it. It doesn't matter how the program works or if you call it AI or a robot or LLM or whatever.
