I think it's weird that we view a teenager's ability to consent to either exist or not exist depending on the age of their partner. How old does someone have to be before we tell the teen their consent is now invalid?

Yes, there's power differential! I think this is true and maybe a valid argument, but we're still pretty inconsistent. There's lots of ways we use power to control underage people, and lots of ways we tolerate even greater power imbalances in sexual situations.

Sometimes it feels surreal that there's so little rape. Men are stronger and hornier and I am so grateful we live in a society where they just constantly go around not raping. Like *half* of all non-human sex is rape, but we managed to get our rape down to a tiny percentage.

Judge VanDyke also apparently thinks that state powers should be voted on by the other states every time they exercise state powers, which the Founders would have found repulsive.
Half a decade ago, I proposed two “bright-line” rules that could resolve a sizable chunk of our Second Amendment cases and make it much harder for recalcitrant judges to ignore the law.  See Duncan v. Bonta, 19 F.4th 1087, 1161 (9th Cir. 2021) (VanDyke, J. dissenting), cert. granted, judgment vacated, 142 S. Ct. 2895 (2022), and vacated and remanded, 49 F.4th 1228 (9th Cir. 2022).  First, if a “firearm product or usage that a state seeks to ban is currently prevalent throughout our nation,” then it should simply be unconstitutional to ban it.5  Id.  Second, if a state has a firearm regulation that “most other states don’t” have, then the regulation should be unconstitutional.6  Id.  I continue to believe that incorporating these bright-line rules into our Second Amendment jurisprudence would accord with Supreme Court precedent, leave minimal room for judicial manipulation, and (perhaps something that my colleagues

The maj. op. points out that SCOTUS has been less than clear about how its 2A tests should work post-Bruen.
This Second Amendment confusion, as detailed in Rahimi, has spread to circuit courts that have analyzed similar shall-issue laws.  As the Tenth Circuit put it, “it is difficult to forecast how the Supreme Court would decide the issue, given the apparent tension between the Bruen two-step framework and the safe harbor list of presumptively lawful regulations.”  Rocky Mountain Gun Owners v. Polis, 121 F.4th 96, 120 (10th Cir. 2024).  Yet despite a wide range of methodological approaches to assessing shall-issue regulations, the circuit courts have converged on one unifying principle: non-abusive, shall-issue laws comport with the Second Amendment.

And while certain background checks, firearms safety courses, lengthy wait times, exorbitant fees, or other components of a shall-issue regime could trigger the Second Amendment’s protections, nothing in Plaintiffs’ Complaint suggests that either the thirty-day restriction or the police station inspection requirement crosses that line. At most, the provisions impose only modest, procedural burdens.  They require compliance with a reasonable deadline and, for firearms that fall into the categories set out in § 134-3(a)(c), see supra note 1, a brief administrative visit to verify basic information.  They do not materially impede Plaintiffs from acquiring firearms.  Even in light of Hawaii’s distinctive tradition of heightened firearm regulation, which the Supreme Court has viewed with skepticism, see Wolford, 146 S. Ct. at 2040, 2046, the requirements at issue here are not abusive.

This seems like a pretty big deal: donors made illegal contributions to Susan Collins and then were awarded lucrative contracts after her office intervened with the Navy. An FBI investigation was dropped under Trump. www.propublica.org/article/fbi-...
To skirt campaign finance laws and conceal the source of the funds, Navatek planned to funnel the donation through a shell company. The CEO wanted assurance that Collins would know where
the money came from. Reed confirmed that she would, the executive said - and that Navatek would get its government contracts.
After the Corner Bakery meeting, Navatek's CEO, Martin Kao, sent an initial $150,000 to the Collins super PAC using the shell company. Two months later, he told Navatek executives that Collins committed to getting the company $32 million in naval contracts, according to an internal company email reviewed by ProPublica.
