The press release also says that he offered to depart voluntarily, but an immigration "judge" told him no. Why? It does not say. By our count at @prospect.org, Curo-Churata is at least the 67th person to die in immigration custody as of January 2025. He should be alive. May he rest in peace.

Another person has died in Trump's concentration camps. 47-year-old Julian Curo-Churata was from Peru. He died on Sept. 29 after he was imprisoned for three months in Richwood Correctional Center in Louisiana. That camp is run by LaSalle Corrections. There's no cause of death listed.

Deep dives like this really put into perspective what Chief Justice Rehnquist was doing in 2000 when he resurrected the Court’s precedents of the 1870s and 1880s, writing that their authors “had intimate knowledge and familiarity with the events surrounding the adoption of the Fourteenth Amendment.”

I think it is very likely that the admin will lose and lose badly in the lower courts. The arguments it is making are just bad. But what would SCOTUS say? Conservative justices (most famously Scalia) have tended to like the rights privileges distinction...

Wichtigstes Anliegen: Wissenschaftsfreiheit schützt zumindest auch epistemische Kompetenz. Beteiligungsrechte sollten deshalb funktionsbezogen gestaltet werden, nicht gruppenbezogen. Die Professorenschaft wird in der jetzigen Dogmatik überprivilegiert. (1/3)

Those who wrote the Reconstruction Amendments offered us a path. Pass a law that requires a consensus among the justices before the Court can reject acts of Congress said Bingham. Pass a law that designates our most fundamental statutes political questions beyond the reach of courts said Trumbull.
