Telco fails to overturn national security ban
A undisclosed carriage service provider has suffered a setback in cases brought
against the Home Affairs minister and ASIO over a secret government decision to bar
them from offering telco services.
CommsDay in 2024 revealed that the Home Affairs minister had for the ϐirst time
employed a power in the Telco Act to direct a carrier or CSP to cease using or supply-
ing carriage services in Australia. The government refused to elaborate to CommsDay
on the circumstances under which it was employed.
However, a new judgement issued by the Full Court of the Federal Court has re-
vealed details of a lengthy legal ϐight the unnamed telco has waged to challenge both
the direction issued under Section 315a of the Telco Act and the adverse security as-
sessment by ASIO, which is a precondition for the minister employing the power.
The judgement, which covers two separate cases brought by the telco, conϐirms
that it was a carriage service provider and that the Director-General of Security, Mike
Burgess, provided the Home Affairs minister with the adverse security assessment in
June 2021.
“The ASA recommended that the minister give a direction under s 315A of the Tel-
ecommunications Act requiring the applicant to cease supplying carriage services in
Australia,” the judgement notes.
The telco, which has been designated MJZP and had its real name suppressed by
the court, successfully applied to the Administrative Appeals Tribunal in August 2021
to have the ASA stayed until the AAT had completed a review of it. ASIO did not op-
pose that stay being granted as long as the application for review was heard within

four to six months, the judgement noted.
Because of secrecy provisions, the tribunal proceeding was partly conducted in a
closed session, with neither MJZP nor its representatives present or able to access
certain materials. Those materials were suppressed after the Home Affairs minister,
originally Karen Andrews then later Clare O’Neil, issued a series of certiϐicates direct-
ing they should not be disclosed to anyone other than the relevant AAT members.
In August 2023, “the Tribunal afϐirmed the decision under review and gave both
open reasons and conϐidential reasons for doing so,” the new judgement notes. “The
conϐidential reasons refer in some detail to the certiϐicated materials and have not
been made available to the applicant or its legal representatives.”
That decision kicked off the two Federal Court appeals as well as a High Court chal-
lenge to the constitutional validity of a section of the AAT Act. The High Court ruled
against MJZP in August 2025.
The Federal Court appeals focused largely on whether the CSP had been denied
procedural fairness, which was rejected. However the judgement leaves open the pos-
sibility that MJZP can pursue additional grounds of appeal from the tribunal.
Home Affairs has previously declined to comment to CommsDay on the use of the
power, use of which requires the minister responsible for ASIO to consult with the
prime minister and communications minister. A direction can be issued when the
Home Affairs minister considers that the proposed use or supply of carriage services
is prejudicial to security.
The deϐinition of security is drawn from the ASIO Act and can include protection
from espionage, sabotage, politically motivated violence, promotion of communal vio-
lence, attacks on Australia’s defence system or acts of foreign interference.
An explanatory memorandum accompanying the 2017 Telecommunications Sector
Security Reforms legislation described s315A, originally established in 2004, as an

Dear Sydney PC Owners: A good friend who is unemployed just had their computer die. Does anyone have a free hand-me-down box? They’re experienced at putting Linux on low-end machines and have quite basic requirements per the attached. DM me and we can discuss the logistics.

Linux friendly but then most stuff is; one I know is not is Alienware but I cant imagine anyone giving that away. Context: I had an hp z420 with 32gb of ram & I fkn loved it but ofc it was old so it died, & the seller replaced it with a no-name box with 8gb & that's what just died now. Don't mind old Apple gear.
