In the pre-publication galleys to his new book, So Ordered: An Originalist’s View of the Constitution, the Court, and Our Country, Justice Alito spelled my last name inconsistently. This is, I suspect, the pettiest possible point on which to open in discussing a Supreme Court justice’s new memoir, and I would never have mentioned it except for the fact that inconsistency turns out to be the organizing feature of the chapter in which I (“the most prolific academic critic of the emergency docket”) repeatedly appear.The central inconsistency of Chapter 8, which is devoted to the emergency docket, is structural: Rather than tackle the subject holistically (as one might expect in a book), Alito mashed together the speech he gave five years ago at Notre Dame Law School with a “postscript.” The former was deeply flawed even at the time (among lots of other things, Alito repeatedly insisted that there was “nothing new” about the Court’s behavior on emergency applications during the first Trump administration and COVID); and the latter tries to move the goalposts away from the specific phenomena to which critics like me have actually objected.The result is to leave readers with a disjointed, inaccurate, and misleading sense of what the debate is even about—to say nothing of how the Court’s own behavior since September 2021 (including Alito’s) has only further undermined the already-flawed claims Alito made back then. Somewhere between the galleys of Alito’s book and the final product (which hits bookstores today), someone apparently figured out that my last name should be spelled the same way (and correctly!) throughout. The other, more significant inconsistencies were, apparently, harder to fix.

countless SCOTUS decisions must never be forgotten, and this is one of them. through the *shadow docket*, with no opinions issued, a majority of the justices stayed a district court ruling that had halted these terrible deportations, leaving migrants without basic due process.

The growth of private credit has often been attributed to tighter banking regulation and low policy rates. Such things certainly played a role early on, but they are difficult to reconcile with the rapid growth in private credit since 2020, when rates went up and regulation, if anything, loosened

NYT clanker Keynes is fun to watch but unconvincing. Keynes thought he had two great insights:(1)declining marginal propensity to consume implies a demand shortfall w/o investment;(2)can't count on investment b/c it's based on vibes and vibes about vibes. This is where he'd have started with AI.

In a series of cases, beginning with Erica P. John Fund, Inc. v. Halliburton Co., 563 U.S. 804 (2011), and concluding with Goldman Sachs Group, Inc. v. Arkansas Teacher Retirement System, 594 U.S. 113 (2021), the U.S. Supreme Court has offered shifting and conflicting understandings of the fraud-on-the-market presumption and its role in class certification. The confusion has filtered down to the lower courts, where class certification determinations have become wide-ranging inquiries into the merits, untethered from the fundamental question whether class treatment is appropriate. This Essay, written for the ILEP 30th Anniversary of the PSLRA Symposium, explores how the Supreme Court has created an impossible class certification maze for parties to navigate, and recommends that courts no longer adjudicate fraud-on-the- market at class certification.

Those who wrote the Reconstruction Amendments offered us a path. Pass a law that requires a consensus among the justices before the Court can reject acts of Congress said Bingham. Pass a law that designates our most fundamental statutes political questions beyond the reach of courts said Trumbull.

We've been discussing this paper at @publicenterprise.bsky.social for the past day and I think, for me, it hammers home that data centers can't be the centerpiece of a local growth or "just transition" story. Municipalities/communities need other horses to bet on, essentially.

I think we'd see a lot more urgency about regulating AI in Silicon Valley if the AI agents suddenly developed a sense of restorative justice, and instead of them threatening humanity with total extinction, they just wanted to redistribute wealth and reverse power hierarchies.
