Since about April, some larger terminated grants (P30 and U19) have left the TAGGS termination PDF. Presumably, those will start to be able to draw funds, correct?

In an email to staff, NIH deputy director Matt Memoli says: "It has come to our attention that some staff are giving guidance... that the word 'diversity' may not be used in any context." "Obviously this is bad guidance... Please ask your staff to use common sense when implementing NIH priorities."
Subject: From the NIH Principal Deputy Director: Guidance relating to NIH Priorities
Colleagues,
It has come to our attention that some staff are giving guidance to various employees that the word "diversity" may not be used in any context, and that anything with the word
"diversity" in it is not allowed. This is not true. For example, an employee was told they could not go to a conference to discuss research on "neurodiverse
individuals." Others are being told not to use the phrase "genetic diversity." Obviously, this is bad guidance. There are clearly many appropriate uses of the word diversity, and in no way does the NIH police speech or banPlease ask your staff to use common sense when implementing NIH priorities or ensuring compliance with executive orders. If they are not sure about something, they should ask up their chain of command to get an answer. For NIH to continue its important mission, all staff must work collaboratively to promote rigorous science that does not discriminate and that will lead to potential breakthroughs for the health of all Americans.
Please share this information with other leadership across your ICOs as appropriate.

In a swift response to this morning's hearing, District Court Judge William G. Young has just ruled that the directives that led to 100s of grant terminations at the NIH are arbitrary and capricious. The directives + subsequent terminations are illegal, he said. "They are of no force and effect."

To add to this, I've had the chance to look at abstracts from year to year and see where some have changed. Whether by force or fear of reprisal, there are instances where even the mention of health disparities have been removed or altered. We can't solve problems if we can't talk about them.

Dr. Bhattacharya's first line of his Monday PM response to The Bethesda Declaration was "We all want NIH to succeed". Like the OSTP Director, the rhetorical 'we' implies that HHS leadership are engaged in good-faith negotiations with the best interests of America's health in mind. (they aren't)
Dr. Bhattacharya on twitter June 9: "We all want NIH to succeed and I believe that dissent in science is productive. However, the Bethesda Declaration has some fundamental misconceptions about the policy directions NIH has taken in recent months. 🧵1/5"

To put these top-line budget numbers in context, cuts of this magnitude would effectively mean no new grants in FY2026. The entire extramural budget would go to existing, continuing grants. An abject failure of American ambition. And a betrayal of our global leadership in health science innovation.

We are hoping that watching the number of overdue grants each month will give us insight into things like funding freezes. Below we see that almost 60% of Columbia's grants whose most recent funding period ended in March are overdue. More on that freeze here: www.science.org/content/arti... 4/5
We have zeroed in on institutions with more than 20 grants that had a budget period ending in March 2025 and plotted the percentage of these grants that were still overdue. Columbia, which has been under a funding freeze since early April, stands out. However, we also see UCD pop out at this time. We will continue to track this metric over time to better understand grant funding delays that may not be reported publicly.

Delays at the NIH likely explain a lot of the 30-day overdue grants. But there are still substantially more primary grants at least 60 days overdue now than last May. We are concerned that many may be effectively terminated. 2/5
A second bar graph shows a similar number of overdue supplements today as in May 2024, but the number of overdue primary grants is far higher.

The District Court of R.I. has ordered a preliminary injuction against the termination of $11 Billion in COVID-19 funding. An earlier TRO in this case resulted in 60-70 NIH grants being reinstated as well as numerous CDC grants. www.courtlistener.com/docket/69829...
Upon consideration of the States' Motion for a Preliminary Injunction (ECF No. 60 ), it is hereby ORDERED:1) Defendants and all their respective officers, agents, servants, employees and attorneys, and any persons in active concert or participation with them who receive actual notice of this order (collectively "Enjoined Parties") are hereby preliminarily enjoined from implementing or enforcing through any means the decision made on or about March 24, 2025 that numerous health programs and appropriations responsible for $11 billion of critical federal financial assistance were "no longer necessary" because the "COVID-19 pandemic is over" ("Public Health Funding Decision"), including any funding terminations, or from taking any action to reinstitute the Public Health Funding Decision for the same or similar reasons. This injunction is limited to funding for Plaintiff States, including their local health jurisdictions and any bona fide fiscal agents of Plaintiff States or their local health jurisdictions. 2) The Enjoined Parties shall immediately treat any actions taken to implement or enforce the Public Health Funding Decision, including any funding terminations, as null and void and rescinded. The Enjoined Parties must immediately take every step necessary to effectuate this order, including clearing any administrative, operational, or technical hurdles to implementation.3) Defendants' counsel shall provide written notice of this order to all Defendants and agencies and their employees, contractors, and grantees by the end of the day on Tuesday, May 20, 2025.4) By the end of the day on Tuesday, May 20, 2025, the Defendants SHALL FILE on the Court's electronic docket a Status Report documenting the actions that they have taken to comply with this Order, including a copy of the notice and an explanation as to whom the notice was sent.

So far this has helped label terminations as "arbitrary and capricious". But the good/bad wedge will certainly be there as they determine what opportunities will even exist in the future.

I feel like we see this strategy in recent court filings from HHS. A couple instances of publishing lists of grants they *didn't* terminate. A way to argue they are just separating good from bad science.
