NEW: In response to DOJ's request for a stay pending appeal of her Haiti TPS order, Judge Reyes questions the "suspect" nature of DOJ's "irreparable harm" arguments, orders DOJ to file a declaration about what actions DHS has taken "in expectation" Haiti TPS would end, and sets a hearing for 2/12.
MINUTE ORDER. The Court has reviewed the Government's 126 Motion to Stay the Court's Order Granting Relief Under 5 U.S.C. § 705 and 127 4 Plaintiffs' Motion to Set Briefing Schedule. The Government took three business days from the Court's decision to file the motion. They now ask the Court to rule within one business day and three hours and do so without identifying any basis for this rushed timetable. Due to the serious issues presented in this litigation, Plaintiffs should be afforded at least the same amount of time as the Government to brief their opposition.
At the hearing on the Government's Motion, the Court expects the Government to articulate, among other things, how the irreparable harm and other stay factors weigh in the Government's favor. The Government contends that the Court "intru[des]... in the workings of a coordinate branch of the Government." Dkt. 126 at 22 (citation omitted). But missing is any concrete example of how the Court does so. This failure is particularly problematic in light of the Government's representations that it was "remote conjecture," "speculation," and
"theoretical" that it would detain or initiate removal proceedings against Haitian nationals if the Termination went into effect. Dkt. 92 at 42; see Dkt. 126 at 23-24. Either the Government does not have any concrete plans to detain and initiate removal proceedings against Haitian TPS holders if the Court stays its decision pending litigation and therefore its own irreparable harm argument is suspect. Or the Government does have such concrete plans and therefore its argument that Plaintiffs will suffer no "irreparable harm" is suspect.So that the Court has all relevant information before it, it ORDERS the Government to submit a sworn declaration from a senior member of the Department of Homeland Security which states what steps, if any, DHS has taken in the expectation of the February 3, 2026, Termination (now stayed) going into effect. Specifically, the declarant must state whether DHS has taken any actionand, if so, which actions)to mobilize members of Immigration & Customs Enforcement to areas heavily populated with Haitian TPS holders, such as Springfield, Ohio, and South Florida. If the Government has taken no action in anticipation of the Termination, the declarant must state that.
The Court ORDERS Plaintiffs to respond to the Government's Motion by February 11, 2026, at 12 p.m. It further ORDERS the Government to file the above-described declaration on or before February 10, 2026, at 10 a.m. The Court will hold a motion hearing February 12, 2026, at 10 a.m. Signed by Judge Ana C. There is zero reason for anyone, especially reporters, to trust anything that comes out of this administration at any level. This is fantastic reporting.
Most of the arrestees the Spotlight Team identified are casualties of the fentanyl crisis, not kingpins making a living off it. They included a man accused of shoplifting chocolate Swiss rolls and Jolly Ranchers from a Hannaford supermarket and a woman who allegedly crashed a car into a column at a local bank and left the scene.

Some of the 171 arrestees had significant quantities of drugs, but neither court documents nor agency spokespersons provided evidence that they were high-ranking members of the notorious syndicate. Many suspects’ only link to Sinaloa was that they were consumers of drugs the cartel may have helped bring into the country.

DEA officials last week said they were unable to comment on the Spotlight findings because of the government shutdown. Instead, they flagged eight federal investigations they said were part of the Sinaloa crackdown.

A big part of the reason for the significant "inefficiency" in government is that the law builds in process and redundancies. It is easy to increase "efficiency" if you are not law-abiding, but the scare quotes are needed because legal compliance is not inefficient if it is part of the goal.

As DOJ argues that federal courts have no authority to order "any particular acts of diplomacy," I want to remind everyone that SCOTUS let Matthew Kacsmaryk seize control of Biden's border policy for 10 months and micromanage diplomatic negotiations with Mexican officials. slate.com/news-and-pol...
The court’s inaction empowered Kacsmaryk to assert complete control over resumption of Remain in Mexico. He ordered U.S. diplomats to negotiate over the program with Mexico “in good faith,” demanding monthly status reports detailing exactly how they were implementing his commands and how much progress they were making. He forced the administration to spend millions of dollars rebuilding temporary structures that the government could use to adjudicate immigrants’ claims. He made the Justice Department tell him the precise number of migrants encountered at the border each month and exactly what the government did with each of them.

On top of these status reports, Kacsmaryk ordered ongoing updates on the administration’s “compliance” with his injunction—that is, detailed explanations of negotiations with the Mexican government to restart Remain in Mexico. These updates were accompanied by declarations from U.S. officials explaining how they were implementing the injunction. When Texas complained that they were not implementing it quickly enough, Kacsmaryk allowed the state’s lawyers to depose the federal officials, compelling them to turn over even more information about high-level diplomatic negotiations with the Mexican government. The lawyers and diplomats undertaking this task at Kacsmaryk’s insistence were subject to the constant threat of contempt and sanctions if they failed to meet his demands. Then–Solicitor General Elizabeth Prelogar later revealed that the judge had forced the Department of State and the Department of Homeland Security to hold weekly calls with “their counterparts in the Government of Mexico” to execute his extensive directives.
