It's clear Kash Patel is distinguishing between doing any specific work on an investigation vs being assigned to an investigation. E.g. I think Patel fired people on the mar-a-lago investigation for *working* on the case not being *assigned* to the case.

I mean this unironically. The court appears to be on a massive juristocratic bent and I think it's important this changes. Force the court to use some other building. Just start knocking down one first street and force the justices to own their hypocrisy if they want something different.

The thing that pisses me off about reporters (not Rupar here) is that they frame the question to Cornyn around "democrat[ic] claims". Frame it around reading the docs and some expertise. The "settlement" can only be amended by agreement with all parties. If you must, say "lawyers claim".

Justices Kagan and Barrett are in congress testifying. Right now in the house. Congress members are giving fawning overviews and treating the justices with the softest of kid gloves. Because of this almost nothing is actually getting asked or answered in any meaningful way.

You can’t do rushed, sloppy, and inaccurate historical work to change legal rules we all live under and not be treated as a player in the president’s political game. If a historian did that, they’d be called a hack, and not taken seriously thereafter. Why should the bar for law profs be lower?

20 of the 53 merits decisions from #SCOTUS so far have divided the justices 6-3 or 5-4. In *19* of those 20, the three Democratic appointees have been on the same side—dissenting 12 times; in the majority 7 times. A Court that was less defined by politics would have far *more* cross-party splits.

So much of today's conservative court movement seems to trace back to grievance about how they think Nixon was wronged and reconstruction was bad. I know some people try to project good faith onto the right, but this is just the most parsimonious explanation to me.

I don't think Slaughter was a case where the dissenters should have "respectfully" dissented. I think it's a bad, bad decision that, coupled with decisions like Trump v USA, will completely upend the US govt.

The whole premise of Slaughter has no basis in the text of the Constitution, early practice, or any kind of original intent. Congress has insulated some officers from at-will presidential removal as it sees fit for more than 200 years. I talked to @narosenblum.bsky.social about it earlier this year:

A reminder: Humphrey's Executor was a 9-0 unanimous decision to curb the power of a left wing president. The apparent through line appears to be Democratic presidents don't get to wield power, but republican presidents do.
