Betreff: Neue Regelung betreffend Familienbeihilfe und Schülerfreifahrt für aus der Ukraine Vertriebene

Sehr geehrte Damen und Herren,

wir informieren Sie hiermit über die aktuelle Situation betreffend den Anspruch auf Familienbeihilfe für Vertriebene aus der Ukraine und die damit verbundenen Auswirkungen auf die Schülerfreifahrt im Schuljahr 2026/27.
Die bisherige Regelung der Familienbeihilfe für Ukraine-Vertriebene ist mit Ende Juni 2026 ausgelaufen. Ukraine-Vertriebene erhalten daher aktuell grundsätzlich keine Familienbeihilfe und wären in Hinblick auf das kommende Schuljahr 2026/27 nicht berechtigt, an der aus dem Familienlastenausgleichsfonds finanzierten Schülerfreifahrt teilzunehmen. (Parlament Österreich⁠)

Rechtsgrundlage:
Nach aktuellem Stand ist jedoch von der Bundesregierung eine Neuregelung der Familienbeihilfe für Ukraine-Vertriebene in Aussicht genommen; die Beschlussfassung ist für Oktober 2026 vorgesehen. Bis zu einer solchen Neuregelung besteht derzeit kein allgemeiner Anspruch auf Familienbeihilfe für Ukraine-Vertriebene. Ukraine-Vertriebene in Beschäftigung können bei Vorliegen der sonstigen Voraussetzungen für ihre Kinder einen Anspruch auf Familienbeihilfe haben.

Für die Teilnahme an der regulären Schülerfreifahrt nach den Bestimmungen des FLAG ist daher entscheidend, ob im konkreten Einzelfall ein Anspruch auf Familienbeihilfe besteht.

1. Beschäftigung und Anspruch auf Familienbeihilfe
Besteht aufgrund einer Beschäftigung ein Anspruch auf Familienbeihilfe und sind die weiteren Voraussetzungen erfüllt, kann die reguläre Schülerfreifahrt nach den Bestimmungen des FLAG in Anspruch genommen werden.
2. Grundversorgung und kein Anspruch auf Familienbeihilfe
Besteht aktuell kein Anspruch auf Familienbeihilfe, besteht auch kein Anspruch auf die reguläre, aus dem Familienlastenausgleichsfonds finanzierte Schülerfreifahrt nach dem FLAG.
Dies betrifft insbesondere Ukraine-Vertriebene, die derzeit keine Familienbeihilfe bezieh…

Sollte eine Schülerin oder ein Schüler aus der Ukraine Leistungen der Grundversorgung beziehen und daher kein Anspruch auf Familienbeihilfe bestehen, besteht kein Anspruch auf die reguläre Schülerfreifahrt nach dem FLAG. Die Abwicklung der Fahrerlaubnis erfolgt in diesen Fällen über die BBU. Die Ausgabe bzw. Übermittlung eines Bestellcodes für die Schülerfreifahrt stellt dabei nicht automatisch einen bestehenden Anspruch auf die Schülerfreifahrt dar.

Wir informieren Sie als zuständige Sozialträger hiermit über diese Änderung und ersuchen Sie, die betroffenen Personen bzw. deren Betreuerinnen und Betreuer entsprechend zu informieren, um Missverständnisse sowie unberechtigte Antragstellungen bzw. Einlösungen von Bestellcodes zu vermeiden.
