Campus rape is really widespread; statistics suggest a significant percent of women who go to college will be raped there; feminism opened up a good conversation about it around 2012-13; it's weird when people treated Cornell like an isolated rather than dramatic example of a pervasive problem.

Appellants have not satisfied the stringent requirements for a stay pending appeal. See Nken v. Holder, 556 U.S. 418, 434 (2009); D.C. Circuit Handbook of Practice and Internal Procedures 33 (2026).
Appellants have not shown a strong likelihood of success on the question of whether Program Statement 5260.01 is arbitrary and capricious because the Bureau of
*Circuit Judge Walker would grant the motion to stay in No. 26-5310 for the reasons in the attached dissenting statement.Prisons (BOP) did not adequately consider its own experience providing gender-affirming care under its prior policy. See Int'l Dark-Sky Ass'n, Inc. v. FCC, 106 F.4th 1206, 1213 (D.C. Cir. 2024) ("An action is arbitrary and capricious when the agency relies on inappropriate factors, fails to consider important aspects of the problem, or ignores relevant evidence."); Butte Cnty., Cal. v. Hogen, 613 F.3d 190, 194 (D.C. Cir.
2010) (explaining that "an agency's refusal to consider evidence bearing on the issue before it constitutes arbitrary agency action"). For example, BOP makes claims about the security impact of providing gender-affirming care without addressing whether such issues have occurred.
Moreover, appellants have not made a strong showing that the district court's order violates the PLRA or improperly grants class-wide relief. Additionally, appellants' argument that the district court's order is overbroad to the extent it affects the Program Statement's provisions regarding surgical procedures is likely forfeited because it was not raised first in the district court. See Gov't of Manitoba v. Bernhardt, 923 F.30 1/3, 179 (D.C. Cir. 2019) ("Absent exceptional circumstances, a party forfeits an argument by failing to press it in district court.").
Because appellants have not made a strong showing that they are likely to succeed on the merits, it is not necessary to address whether they have established irreparable harm or whether the remaining factors favor a stay.
The Clerk is directed to enter a briefing schedule.

And the equitable factors applicable for obtaining emergency relief from this Court do not favor a stay.

In my view, based on the briefing the Court has received at this interim stage, there is at least a fair prospect that the final rule falls within the Postal Service's statutory authority. See 39 U. S. C. §401(2). But applying the rule in the 2026 elections would be arbitrary and capricious in violation of the Administrative Procedure Act because state and local election officials do not have sufficient time to reasonably implement the rule before the elections. See 39
U. S. C. §3001(m); 5 U. S. C. §706(2)(A). For that reason, I concur in the denial of the application for stay.

UPDATE: DOJ decided to play fast and loose this morning. Without even filing a notice of appeal in the DSCC case, SG Sauer made arguments to SCOTUS about the merits of the DSCC case injunction in a "supplemental brief" in the stay application pending in the California/LWV cases out of Mass.
Late last night, the United States District Court for the District of Columbia entered a preliminary injunction in three consolidated cases, DSCC v. Trump, No.
26-cv-1114 (D.D.C.); League of United Latin American Citizens v. Trump, No. 26-cv-1132 (D.D.C), and NAACP v. Trump, No. 26-cv-1151 (D.D.C.). See DSCC D. Ct. Doc.
192 (Sept. 13, 2026) (App., infra, la-24a). Much like the injunction at issue here, the D.D.C. injunction bars the Postal Service from implementing and enforcing its Ballot
Mail for Federal Elections Rule. See App., infra, 25a-26a. Because that decision does not contain any materially new reasoning, a stay in this case will require the district
court in DSCC (or the United States Court of Appeals for the District of Columbia

Circuit) to immediately grant a parallel stay. See Trump v. Boyle, 145 S. Ct. 2653, 2654 (2025) (explaining that this Court's interim orders "inform how a court should exercise its discretion in like cases").On the merits, although the DSCC court recognized that the Rule's labeling requirements might fall within the Postal Service's authority, see App., infra, at 16a n.7, it concluded that the Rule's requirement that state officials submit a list of intended ballot recipients as a condition of mailing ballots to those recipients likely exceeded the Postal Service's authority, reasoning that that requirement is about regulating elections rather than delivering mail, id. at 15a-16a. That rationale, which is essentially the same as the rationale of the district court in this case, see Appl.
App. 27a-30a, fails for reasons the government has already explained. In particular, creating lists of recipients helps to ensure that mail is sent only to the addressees the sender intends and to track if any fraudulent use of the mail occurs. See Appl. 9, 28;
Reply Br. 17. As such, that requirement falls well within the Postal Service's rule-making power and is analogous to the existing registration and tracking require-
ments for cremated remains or to a hypothetical rule requiring senders to provide
more detailed information regarding mailings to retirement communities that have been targeted for fraud. See Appl. 16-19; Reply Br. 7, 10-12.
