I figured it would be a Roberts majority and a great Jackson concurrence in the birthright citizenship case. Also suspected Kavanaugh would go for the statutory argument, based on oral argument. Gorsuch dissent was shocking but maybe nothing should shock me these days. Glad that at least it's over!

THIS MATTER is before the Court on Plaintiffs' Consent Motion for a 90 Day Extension ("Motion") (DE 40). In the Motion, Plaintiffs ask the Court "to grant an extension for a period of ninety (90) days in all proceedings in this matter." (DE 40 at 1). The only scheduled event at issue is Defendants' response to the Complaint. For the reasons stated below, the Court will, sua sponte, stay Defendants' obligation to respond and set a briefing schedule to address the question of the Court's subject matter jurisdiction.In the instant case, Defendants have not yet filed any notices of appearance.
Nonetheless, the Parties have advised the Court that they are engaging in discussions to
resolve this matter. Moreover, although President Trump avers that he is bringing this lawsuit in his personal capacity, he is the sitting president and his named adversaries are entities whose decisions are subject to his direction.? Indeed, President Trump's own remarks about this matter acknowledge the unique dynamic of this litigation. 3 Accordingly,
it is unclear to this Court whether the Parties are sufficiently adverse to each other so as
to satisfy Article Ill's case or controversy requirement.III. CONCLUSION
The Court hoped to evaluate this issue after Defendants responded to the Complaint.
However, in light of Plaintiffs Motion, the Court will ask the Parties to address the question of subject matter jurisdiction before addressing the relief requested in the Motion.
Accordingly, it is ORDERED AND ADJUDGED that, by May 20, 2026, the Parties shall each file a memorandum of law that addresses the issue of whether a case and
controversy exists in this matter so as to establish the Court's jurisdiction. The Court SETS a hearing for 10:00 A.M. on May 27, 2026. The Parties should come prepared to discuss the issues identified above.

BU’s DOS and Office of Judicial Affairs were thus doing the work of tamping down protest well before the reelection of Donald Trump, the deployment of ICE against protesters and the broader entrenchment of an authoritarian program in the federal government. Unfortunately, those offices and other units of the University have continued to do so to the present moment, in a local reflection of Trumpian disregard for law and free speech, notwithstanding repeated efforts of faculty and affected students to engage with the University administration.

Discrimination based on sex is expressly prohibited under Montana’s unique Nondiscrimination Clause––“[n]either the state nor any person, firm, corporation, or institution shall discriminate on account of . . . sex . . . .” Thus, Article II, Section 4 is
unequivocal in its intolerance for discrimination based on sex. Because sex discrimination involves a fundamental right under Article II, the appropriate level of judicial review is strict scrutiny. Snetsinger, ¶ 17.

She was granted withholding of removal from India *decades* ago, and had been living and working legally (including for the U.S. government!) ever since. But with third country removals now a real option, TSA shared her data with ICE and they arrested her at the airport on her way to a job.
ast month, Meenu Batra, 53, who has lived in the South Texas border colonia of Laguna Heights since 2002, was on her way to Milwaukee, Wisconsin, to work another case. She’s been a court interpreter for over 20 years, the only one licensed in Texas for Hindi, Punjabi, or Urdu. Her language skills are requested nationwide, where she’s contracted to help people making their way through the immigration court system, just as she did for herself 35 years ago when she immigrated from India to New Jersey before settling in Texas.

She planned to meet with her adult children in Austin after the Wisconsin trip, the only difference she foresaw in an otherwise typical trip. Her routine for years included flying from either Harlingen or Brownsville to far-flung parts of the country where South Asian immigrants needed language access. For this trip, the flight was out of Harlingen.

But, around 5 p.m. on March 17, Batra was detained by Immigration and Customs Enforcement (ICE) agents after passing through security at Harlingen International Airport. In a sworn deposition that was filed as part of a petition for habeas corpus—a legal request to be released on the grounds that the detention is unlawful—Batra said the people who arrested her did not have visible badges nor were they wearing uniforms. One of those agents had asked Batra if she knew she was in the country illegally and that she had a deportation order. She replied that her work authorization status, which she applied for regularly after being granted a legal status called withholding of removal by a New Jersey immigration judge decades ago, was good for another four years.

“That doesn’t mean you can be here forever,” the agent replied. Two more plainclothes agents would join the two that detained her, bringing her down the escalator and to the front of the airport.

IMPORTANT: Under federal law, it's very hard, at times near-impossible, to sue federal law enforcement officers for civil rights violations. But legal theorists have said for decades that there is a possible way to sue under state law instead. This is a VERY big test case.
This case could re-establish an important legal avenue for people to bring claims against federal officers under a state civil rights act.

The Maine Civil Rights Act allows people to bring claims against federal officers for violations of federal law. Specifically, it affords a cause of action for violations of “the rights secured by the United States Constitution” by “any person.” In general, claims against federal officials are brought against the United States, but there is a crucial exception in federal statute. The Westfall Act of 1988 states this limitation on remedies against federal officials “does not extend or apply to a civil action against an employee of the Government [] which is brought for a violation of the Constitution of the United States.”

The Supreme Court allowed some types of actions against federal officers for federal constitutional violations in its 1971 Bivens decision, but the court has sharply narrowed that in recent years. Re-establishing the ability to bring claims under state law could reopen a crucial avenue for people to seek justice when the federal government violates their constitutional rights.
