Happy Constitution Day! But yes, especially these days, when thinking about constitutional law, it’s better to think about our *constitutions* — plural.

Once again, people are debating what does or doesn't constitute discrimination against Jews. Relatedly, UCLA Law's Jon Michaels and I have an article entitled "Misdiagnosing Anti-Jewish Animus," forthcoming in the Cardozo Law Review: papers.ssrn.com/sol3/papers....

Definitely won't watch this. But I could be tempted to watch "THE HABEAS LITIGATION EXPERIMENT," which follows 30 lawyers, half of whom are assigned to represent the Dept of Corrections and half of whom are assigned to represent prisoners.

Netflix has announced a new reality series titled ‘THE NEW STANFORD PRISON EXPERIMENT’. The series follows 30 participants who enter a real prison and are randomly assigned as guards or prisoners. They must see if they conform to the roles or if morality wins.

A federal district court has now issued a preliminary injunction, holding that the plaintiffs' Free Exercise and Second Amendment claims are likely to succeed against Montgomery County's ban on firearms at houses of worship. Opinion here: storage.courtlistener.com/recap/gov.us...

Montgomery County, Md. passed a law banning the carrying of firearms within 100 yards of places of worship or places of public assembly. It's now being sued by a synagogue that says the law will disarm its community volunteer security team.

On the morning of 9/11/01, I was a law student running an errand. People in the store were discussing the attack. I got in my car and turned on the radio. I vividly remember the newscaster breaking character and begging first responders to head to the towers. Which they did.

Hopefully today's news is a sign that SCOTUS won't stymie state courts when it comes to partisan gerrymandering. In Rucho, SCOTUS decided only “whether there is an ‘appropriate role for the Federal Judiciary’" on partisan gerrymandering. It said no. But state courts should be allowed to police it.

Just a reminder that this Missouri partisan gerrymandering mess is one corner of a much bigger, national gerrymandering mess which SCOTUS invited in 2019 when it ruled, in Rucho v Common Cause, that there's just no darned way courts can do anything about it www.oyez.org/cases/2018/1...

Traffic laws make it impossible to drive without committing an offense, and camera systems increasingly enable police to find traffic offenses by *anyone of their choosing.* Weirdly, this problem might eventually be solved, not by law reform, but by driverless cars.

A single justice of the Massachusetts Supreme Judicial Court has DENIED Lindsay Clancy's petition for emergency relief.

Translation: The defense intends to petition to a single justice of the Supreme Judicial Court under Mass. G.L. ch. 211, §3. Technically the single justice court is the Supreme Judicial Court for the County of Suffolk, not the Supreme Judicial Court for the Commonwealth.

In light of the Wachtell report about the Clippers, I've decided that the many hours I've devoted to analyzing the NBA is not, as I previously thought, a waste of time, but instead part of my robust pro bono practice

wild details in new @aclu.org/@aclu-nh.bsky.social suit about monitoring devices that the public housing authority in Concord, NH, installed in affordable housing units www.nytimes.com/2026/09/02/t...
But when some residents looked up Minut online, they were aghast at the wide range of data the devices collected: decibel levels, air quality and Bluetooth signals from mobile devices, a proxy for how many people were in a unit at any given time. The device even acts as a motion detector. The lawyers sought more information about the monitoring through public records requests and were given the minute-by-minute data collected for each apartment. It amounted to hundreds of millions of sensor readings, with thousands of data points about the noise and motion in each apartment.

Swalwell aside, courts should take a hard look at the idea that under, say, the plain view doctrine, law enforcement can use agents or surveillance cameras to warrantlessly obtain passcodes that people inevitably type in public as part of life in modern society.

I see that social media has once again set its sights on public defenders, so this is your regular reminder that when public defenders are good at their jobs, you will basically have NO IDEA if they personally agree with the arguments they're making on behalf of clients.

Fine to just ignore someone who justifies scapegoating and political violence against one (and only one!) ethnic group. But if you campaign with that person, that seems like something a court could consider when deciding whether your subsequent actions in office are discriminatory.
