100%. Rosane Ferreira-De Oliveira came into the United States as an asylum seeker. Won her asylum case and was NOT the subject of DHS's abduction. They used her daughters and the infant to lure her, violentely and unlawfully detain her and spread lies about her.

It bears repeating. It’s easy to look at yesterday’s awe inspiring general strike being immediately followed by another murder and get discouraged, to assume that nothing we do matters because they have the guns. And yes, they have the guns. Tragically, they will keep using them, because that’s all they have. We will have to mourn again, goddamnit,  but that doesn’t mean we’re not winning. They have no more moves. They’re losing support by the day. And this movement of millions of neighbors worldwide isn’t going anywhere. Keep mourning. Keep loving. Keep organizing. Take turns when necessary. Remember there are roles for everybody- some on front lines, some as support. Yes, they can do the worst to us, and they will. But it’s still true. They wish they had what we have. They have the guns, but we have each other. 

In the name of all who’ve been victimized, let’s keep loving each other harder than they could ever hope to hate us.

What else of note is going on here? Well, HUD claims that agency interpretations of statutes are entitled to no deferential weight after the Supreme Court's decision in Loper Bright. That's just wrong. Loper Bright reinforced the existence of Skidmore deference. That's a lesser form of... 10/

...how HUD will apply the Act when it is exercising its statutorily mandated enforcement role. Of course, civil rights and housing justice advocates have ample reason to be concerned that HUD will act lawlessly, if it even bothers to accept jurisdiction over disparate impact complaints. 9/

In a proposed rule published in November, the CFPB articulated the position (contrary to mountains of legislative history) that ECOA did not allow for disparate impact claims. The position HUD is staking out here is essentially a dodge. The Department is saying it is the courts' role to set... 5/

It would have maintained the pretense that the disparate impact framework endured while making it functionally impossible for a plaintiff or complaint to ever prevail. Also, HUD isn't taking the route taken by the CFPB with respect to the Equal Credit Opportunity Act. 4/

Unlike in the first Trump Administration, HUD is not setting forth a standard for evaluating disparate impact claims. Back then, HUD issued a rule (subsequently enjoined by the courts) that would have made the disparate impact standard a nullity through a death by a thousand cuts approach. 3/

Like any proposed rule, the fact that HUD is proposing changes does not alter what the law is unless and until it is finalized. The HUD disparate impact rule that was originally promulgated during the Obama Administration and that was restored under Biden remains in effect. 2/

The @bostonglobe.com recently published an article about Holyoke schools detailing the district's struggles. It barely mentioned the fact that the district was controlled by the state for a full decade. Don't worry, though, I got my eye on 'em. Link here and full text in alt text on the screenshot.
After a decade of receivership, school system is no better off
In his article on Holyoke Public Schools, Danny McDonald details many of the challenges facing this long under-resourced school district. It is surprising, then, that in such a close examination, he largely overlooks the most significant takeaway of the story: After a decade of state control, Holyoke is no better off.

Holyoke struggles with many of the difficulties common to our Gateway Cities. One major difference, however, is that the district is just one of a few to be taken over by the Department of Elementary and Secondary Education. Given only a passing mention of Holyoke’s recent exit from receivership, a reader may assume that the district’s current woes are the fault of its educators and leaders.

The article does not mention the 2025 reintroduction of the Thrive Act, which would remove the state’s power to take over “underperforming” districts. Readers of a story about Holyoke’s challenges should know that there’s a proposal before the Legislature that would ensure we don’t take another 10 years at another district to learn the same lesson about the failures of receivership.
